POLITICA DE PROTECCIÓN DE DATOS, PRIVACIDAD Y COOKIES.

En cumplimiento del Reglamento (UE) 2016/679 (Reglamento General de Protección de datos) y su normativa de desarrollo, así como la Ley Orgánica 3/2018, de 5 de diciembre, de Protección de Datos y garantía de derechos digitales, desde “Squeaky clean toys” (en adelante Squeaky) le ofrecemos la siguiente información de su interés en relación al tratamiento de sus datos personales:

1.- RESPONSABLE DEL TRATAMIENTO.
Sus datos serán tratados por “Squeaky clean toys”.

2.-FINALIDAD DEL TRATAMIENTO Y LEGITIMACIÓN.

Le informamos que solamente utilizaremos sus datos para finalidades legítimas, tales como:

– Cumplimiento de la relación contractual y/o comercial: sus datos serán tratados para poder mantener y cumplir las obligaciones derivadas de la relación contractual y/o comercial.

– Cumplimiento de obligaciones legales (Agencia Tributaria, acciones judiciales, etc.).

– Envío de comunicaciones informativas sobre posibles incidencias o brechas de seguridad informática/de datos.

– Envío de ofertas y promociones comerciales sobre nuestros productos y/o servicios.

– Poder participar en los procesos de selección de personal que lleve a cabo esta entidad si usted nos ha enviado su currículo o se ha inscrito en los procesos de selección.

– Elaborar un perfil comercial en base a la información facilitada por usted con el objeto de mostrarle o remitirle publicidad personalizada en base a sus hábitos de consumo y/o preferencias. Dicho perfil puede elaborarse a través de las cookies o cualquier otro medio. En cualquier caso, no se tomarán decisiones automatizadas en base a dicho perfil que produzcan efectos jurídicos o significativos para usted.

– Hacer posible la comunicación (pública) entre los usuarios antes de comenzar el proceso de compra-venta, así como la comunicación (privada) una vez iniciada dicha transacción. En ambos casos Squeaky tendrá acceso a las conversaciones públicas y privadas entre los usuarios para salvaguardar, en la medida de lo posible, el cumplimiento de las normas de la comunidad y de la legislación aplicable.

– Para cualquier otra finalidad que previa y expresamente haya sido autorizada por usted.

Le informamos que, en cumplimiento de nuestra filosofía de protección de la privacidad de nuestros usuarios, en ningún caso y bajo ninguna circunstancia venderemos o cederemos ninguno de sus datos a terceros.

3.- ¿QUÉ DATOS RECOPILAMOS?

En virtud del principio de minimización de datos Squeaky recoge el mínimo numero de datos posibles para hacer funcionar los servicios web.

Entre los datos recopilados, adicionalmente a los recogidos y anonimizados a través de las cookies, se encuentran los siguientes, principalmente procedentes de su inclusión por el usuario a la hora de crearse una cuenta personal:

– Nombre, dirección de correo electrónico y/o número de teléfono.
– Nombre de usuario, contraseña (almacenados en formato cifrado).
– El texto descriptivo que el usuario puede escribir sobre sí mismo y/o sobre los productos listados.
– Ofertas y solicitudes que el usuario ha publicado en el servicio.
– Comentarios e insignias dados y recibidos.
– Datos estadísticos sobre el uso del servicio, por ejemplo: número de veces que el usuario ha iniciado sesión.

Aunque Squeaky recopila estos datos esenciales, ninguno de ellos será público salvo el “nombre de usuario”. Este nombre de usuario de forma predeterminada se compone de su nombre y de la primera letra de su segundo apellido. El usuario puede cambiar este “nombre de usuario” a uno de su elección, con excepción de las siguientes circunstancias para las que Squeaky se reserva el derecho de cambiar el “nombre de usuario”: coincidencia de nombres con otros preexistentes (prevaleciendo el que primero se creó) registrado en la web; en caso de que se considere que el nombre elegido es inapropiado; en caso de que coincida con otros nombres que puedan aparecer en la web y que pueda llevar a confusión; así como en caso de que el nombre de usuario coincida con el nombre de otra persona, entidad, nombre o marca comercial registrada para cuyo uso el usuario no esté legalmente autorizado.

En el caso de que el usuario quiera realizar alguna transacción en la plataforma web se le puede solicitar que proporcione cierta información relevante para su pedido, que puede incluir adicionalmente a los mencionados anteriormente, entre otros, su número de tarjeta de crédito, la fecha de vencimiento de la misma, su dirección de facturación y distintos datos sobre el envío. El usuario autoriza a Squeaky a proporcionar dicha información a terceros que procesen los pagos con el fin de facilitar la correcta transacción.

4.- ¿A QUIÉN FACILITAREMOS SUS DATOS?

Sus datos únicamente serán cedidos o comunicados a aquellas entidades o administraciones que sean estrictamente necesarias para poder prestarle los servicios o mantener la relación comercial libremente aceptada; a aquellas entidades o administraciones a las que tengamos la obligación de hacerlo en cumplimiento de alguna Ley, así como a aquellas entidades o administraciones a las que usted nos haya autorizado expresamente. En ningún caso y bajo ninguna circunstancia venderemos o cederemos ninguno de sus datos a terceros.

El tratamiento de los datos personales no está externalizado, sino que los datos de registro se almacenan en un servidor arrendado a una tercera empresa.

5.- PLAZO DE CONSERVACIÓN DE SUS DATOS.

Sus datos serán conservados mientras dure la relación contractual y/o comercial, el tiempo necesario para cumplir con las correspondientes obligaciones legales, y el plazo de prescripción de las acciones judiciales pertinentes. En todo caso Squeaky se compromete a borrar los datos del usuario cuando nos solicite su supresión en los términos previstos por la Ley o cuando los mismos no sean necesarios, en base al principio de minimización de datos. En caso de que por un error humano estos datos no se borren en el tiempo indicado, o bajo las circunstancias mencionadas, y en todo caso antes de formular cualquier tipo de reclamación externa, el usuario deberá solicitar a Squeaky que borre dichos datos, teniendo squeaky un periodo de 1 mes para realizarlo. En caso de no avisar a Squeaky de este error antes de formular cualquier reclamación externa, y/o de no haber esperado el plazo establecido, no será exigible responsabilidad ninguna.

6.- SUS DERECHOS.

Podrá ejercitar cualquiera de los siguientes derechos enviando una solicitud por escrito junto a una fotocopia de su DNI/pasaporte a la dirección de correo electrónico rights@squeakycleantoys.com y poniendo como asunto en dicho correo: “Derechos ARCO+”.

El usuario podrá ejercer los siguientes derechos:

I. Información: Podrá pedir que le informemos sobre si tratamos sus datos personales.

II. Acceso: Podrá pedir que le informemos sobre cuáles son los datos personales que hemos incluido en nuestros ficheros, las finalidades para las que han sido recabados y en base a que causa de legitimación lo hacemos.

III. Rectificación: Podrá solicitarnos que modifiquemos sus datos personales cuando sean inexactos o que los completemos cuando estén y/o sean incompletos.

IV. Supresión: Podrá solicitarnos la eliminación de sus datos personales cuando, entre otros motivos, retire su consentimiento y/o los datos ya no sean necesarios para los fines que fueron recabados.

V. Oposición: Podrá solicitar que no se traten sus datos personales.

VI. Limitación: Podrá solicitar la limitación del tratamiento de sus datos cuando se cumpla alguna de las condiciones siguientes:

a) Cuando impugne la exactitud de los datos personales y mientras se comprueba la exactitud de los mismos.

b) Cuando el tratamiento sea ilícito y el interesado se oponga a la supresión de los datos personales y solicite en su lugar la limitación de su uso;

c) Cuando el responsable ya no necesite los datos personales para los fines del tratamiento, pero el interesado los necesite para la formulación, el ejercicio o la defensa de reclamaciones;

d) Cuando el interesado se haya opuesto al tratamiento mientras se verifica si los motivos legítimos del responsable prevalecen sobre los del interesado.

VII. Portabilidad: Tendrá derecho a recibir los datos que nos ha facilitado en un formato estructurado, de uso común y lectura mecánica, siempre y cuando los mismos estén automatizados, así como a que los trasmitamos a otro responsable.

7.- MENORES E INCAPACES.

Desde Squeaky restringimos el acceso al uso de nuestra web a personas mayores de edad (pudiendo ser ésta distinta dependiendo del país o región desde el que se acceda), así como con capacidad legal para contratar. No es posible convertirse en usuario, ni mucho menos realizar una transacción, si el usuario no es mayor de edad y tiene plena capacidad legal para contratar, aun a pesar de contar con autorización de sus progenitores y/o tutores legales.

8.- MEDIDAS DE SEGURIDAD.

De conformidad con la legislación vigente, Squeaky se obliga a implementar las medidas técnicas y organizativas que resulten necesarias en cada momento para garantizar la seguridad de sus datos y evitar su alteración, pérdida o tratamiento no autorizado.

Squeaky solo será responsable de los datos almacenados en sus propios servidores y cuando el perjuicio se haya ocasionado mediando dolo, en ningún caso cuando haya mediado diligencia debida y/o los datos se almacenen en un servidor externo y/o arrendado, pues en tal caso la responsabilidad, en su caso, será derivada a la empresa titular del servidor.

En caso de que haya una fuga de datos producto de un jaqueo, de un fallo del software o de cualquier causa, se le informará a través de correo electrónico de que los datos han podido filtrarse en internet y de las posibles formas de actuar. Igualmente, en el caso hipotético de que esto ocurriese, Squeaky se compromete a informar inmediatamente de esto a la AEPD.

El usuario y Squeaky tomarán de forma independiente, personal, paralela y teniendo en cuenta el presente acuerdo de “protección de datos, privacidad y cookies” las medidas de seguridad y control de los datos que sean necesarias, así como de las obligaciones que se puedan derivar.

9.- POLÍTICA DE COOKIES.

Esta Política de cookies explica qué son las cookies y cómo las usamos, los tipos de cookies que usamos, es decir, la información que recopilamos usando cookies y cómo se usa esa información, y cómo administrar la configuración de cookies.

a) ¿Qué son las cookies?

Squeaky utiliza cookies que se quedarán almacenadas en el ordenador. Las cookies son pequeños archivos que nuestro ordenador envía al suyo, pero que no nos proporcionan información ni sobre su nombre, ni sobre cualquier dato de carácter personal suyo, por ser anónimos. Las cookies que utilizamos no pueden leer datos de su ordenador ni leer las cookies que preexistan en el.

La información obtenida por las cookies es totalmente anónima y en ningún caso puede ser asociada a un usuario concreto e identificarlo.

Las cookies son pequeños archivos de texto que se utilizan para almacenar pequeños fragmentos de información. Se almacenan en su dispositivo cuando el sitio web se carga en su navegador. Estas cookies nos ayudan a hacer que el sitio web funcione correctamente, hacerlo más seguro, brindar una mejor experiencia de usuario y comprender cómo funciona el sitio web y analizar qué funciona y dónde necesita mejorar.

Cuando el usuario se encuentre navegando por nuestra web, el servidor donde se encuentra alojada la misma reconoce automáticamente la dirección IP de su ordenador, el día y la hora en la que comienza la visita, en la que abandona la visita, así como información sobre las distintas secciones consultadas. – Según la entidad que las gestione.

Cookies propias: son aquellas que se envían al equipo terminal del usuario desde un equipo o dominio gestionado por el propio editor y desde el que se presta el servicio solicitado por el usuario.

Cookies de tercero: son aquellas que se envían al equipo terminal del usuario desde un equipo o dominio que no es gestionado por el editor, sino por otra entidad que trata los datos obtenidos través de las cookies.

– Según la finalidad que se les dé.

Cookies técnicas/necesarias: son aquellas que permiten al usuario la navegación a través de una página web, plataforma o aplicación y la utilización de las diferentes opciones o servicios que en ella existan.

Cookies de preferencias o personalización: son aquellas que permiten recordar información para que el usuario acceda al servicio con determinadas características que pueden diferenciar su experiencia de la de otros usuarios, como, por ejemplo, el idioma, el número de resultados a mostrar cuando el usuario realiza una búsqueda, el aspecto o contenido del servicio en función del tipo de navegador a través del cual el usuario accede al servicio o de la región desde la que accede al servicio, etc.

Cookies de análisis o medición (Estadísticas): son aquellas que permiten al responsable de las mismas el seguimiento y análisis del comportamiento de los usuarios de los sitios web a los que están vinculadas, incluida la cuantificación de los impactos de los anuncios.

Cookies de publicidad comportamental (Marketing): son aquellas que almacenan información del comportamiento de los usuarios obtenida a través de la observación continuada de sus hábitos de navegación, lo que permite desarrollar un perfil específico para mostrar publicidad en función del mismo.

– Según el plazo que permanezcan activas:

Cookies de sesión: son aquellas diseñadas para recabar y almacenar datos mientras el usuario accede a una página web. Cookies persistentes: son aquellas en las que los datos siguen almacenados en el terminal y pueden ser accedidos y tratados durante un periodo definido por el responsable de la cookie, y que puede ir de unos minutos a varios años.

c) ¿Que tipo de cookies utilizamos nosotros?

Como la mayoría de los servicios en línea, En “Squeaky Clean Toys” utilizamos cookies propias y de terceros, con duración de sesión y/o persistentes, así como técnicas, de preferencias, análisis y marketing.

Puede prestar (o no hacerlo) o retirar su consentimiento granular sobre cada una de las cuatro diferentes categorías de cookies, a través del siguiente enlace o del banner -pop up de la pantalla principal.

Nota: Las cookies de origen son en su mayoría necesarias para que el sitio web funcione correctamente y no recopilan ninguno de sus datos de identificación personal.

10.- BILATERALIDAD DE LAS OBLIGACIONES.

Este acuerdo obliga a las dos partes firmantes (usuario y Squeaky) por igual.

Ambas partes se obligan a cumplir con las obligaciones establecidas en el presente acuerdo. El usuario deberá cumplir con todas y cada una de las obligaciones fijadas en el presente acuerdo con respecto a los datos que reciba de Squeaky, con iguales garantías que lo hará Squeaky con los que reciba del usuario. El usuario, al aceptar este acuerdo, es consciente de que no solo adquiere derechos, sino también obligaciones.

El incumplimiento de las obligaciones mencionadas en los Términos y condiciones y/o en las políticas de Squeaky puede conllevar una acción disciplinaria que puede incluir, entre otras medidas, la suspensión definitiva de la cuenta.

TERMINOS Y CONDICIONES GENERALES DE USO DE LA PÁGINA WEB Y PLATAFORMA WEB – MARKETPLACE

DERECHOS Y OBLIGACIONES DE LOS USUARIOS

1. Ámbito de aplicación general.

Squeaky Clean Toys (en adelante Squeaky) le ofrece el acceso y uso de sitios, servicios, aplicaciones y herramientas web (colectivamente: ‘Servicios’ ).

El uso de la web (página web y plataforma web-‘Market place’) implica la aceptación de todos los términos y condiciones, a saber:

• Términos y condiciones de política de protección de datos, privacidad y cookies.
• Términos y condiciones generales de uso de la página-plataforma web.
• Términos y condiciones generales de contratación (E-commerce).
• Aviso legal.
• ‘Guía de higiene’
• “Requisitos de la comunidad”

Squeaky te recomienda que los leas detenidamente y nos escribas si tienes dudas al respecto, todo ello antes de aceptarlas. Si las aceptas entenderemos que lo has hecho habiéndolas leído y entendido.

1.1. Sobre Squeaky Clean Toys y sus servicios.

Squeaky es una plataforma web que permite a los usuarios comprar y vender juguetes aprobados para adultos, así como posibilitar la transacción económica de forma segura.

Squeaky, por tanto, no es titular ni está en posesión de ningún artículo de los que aparecen listados y/o en venta a través de Squeaky. Tampoco participa en las transacciones económicas, ni en los envíos y recogidas de lo comprado-vendido, entre usuarios. El contrato de compraventa se hace de forma directa e independiente entre usuarios Si bien podemos reflejar en la web datos previamente aportados por los usuarios como precios, gastos de envío, listado de productos y orientación a través de la página web, lo cierto es que todos estos datos no dejan de ser orientativos y en ningún caso información propia y/o generada ‘ex Novo’ por Squeaky. Por todo ello debe ser el propio usuario el que tome el control de la situación, del uso de la plataforma, tome las cautelas necesarias y asuma a título individual las obligaciones derivadas de los servicios.

Por tanto, el Servicio principal de Squeaky consiste en ser una plataforma web que facilita la inserción (siendo previamente aprobados -o no- por Squeaky en base al cumplimiento de una serie de requisitos), por parte del vendedor, de anuncios de venta de juguetes para adultos, de su puesta en comunicación con posibles interesados; así como a posibilitar la propia transacción económica entre comprador y vendedor.

1.2 Jerarquía y contenido.

Los presentes Términos y Condiciones constituyen el marco básico de regulación de las relaciones establecidas entre “Squeaky” y el usuario, y conjuntamente, en su caso, con los Términos y condiciones particulares de contratación (e-commerce) en caso de que además de ser usuario, sea comprador y/o vendedor, formarán el cuerpo que rige cada una de las relaciones establecidas entre el “Squeaky” y cada usuario, debiendo aplicarse e interpretarse éstas y aquellas (condiciones de uso y condiciones de contratación) conjunta y sistemáticamente. Prevalecerán en todo caso las condiciones que “Squeaky” estime más oportuna en cada caso.

Los presentes Términos y Condiciones se aplicarán a todos los servicios profesionales prestados por “Squeaky” a los usuarios, a través de su web. Lo que no se exprese aquí, será de aplicación por analogía lo dicho en la “Política de protección de datos, privacidad y cookies”.

1.3. Partes y definiciones.

Las siguientes palabras, con independencia del significado léxico que tengan, deberán interpretarse siempre de la siguiente forma, con independencia de que estén en singular o en plural:

– Squeaky: “Squeaky clean toys”.

– Usuario y/o Usuarios: toda persona física o jurídica que acceda/visite la página web Squeaky, con independencia de que se acabe creando una cuenta-perfil en la plataforma web de Squeaky y de que acabe siendo comprador, vendedor, ninguna o ambas.

– Página web: todos los contenidos alojados en el siguiente sitio web: https://www.squeakycleantoys.com/con exclusión de los contenidos a los que se hace referencia en el siguiente punto “Plataforma web” y/o “Marketplace”.

– Plataforma, Plataforma web y/o Marketplace (indistintamente): plataforma de compra-venta alojada en el siguiente sitio web https://usmarketplace.squeakycleantoys.com/ con exclusión de los contenidos a los que se hace referencia en el anterior punto “Página web”.

– Web o Sitio web: Referido conjuntamente a la página web y a la plataforma web.

– Servicios: Toda prestación que realice Squeaky a través de su “página web” o de su “Plataforma web”, así como de sus aplicaciones y herramientas web, indistintamente.

– Cuenta, Cuenta personal o Perfil: espacio personal creado por el usuario dentro de la plataforma web, con independencia de que acabe siendo comprador, vendedor, ninguna o ambas.

– Nombre de usuario: identificación predeterminada asignada al usuario al crearse una cuenta, compuesta de su nombre y la primera letra de su segundo apellido, pudiendo cambiarla con posterioridad a una identificación de su elección.

– Comprador: Usuario con cuenta personal que intenta (con independencia de si la formaliza) una transacción en la plataforma web para comprar un bien listado en la misma.

– Vendedor: Usuario con cuenta personal que intenta (con independencia de si la formaliza) una transacción en la plataforma web para vender un bien listado en la misma.

– Empresa, Squeaky, Nosotros y/o Nuestro (indistintamente): “Squeaky clean toys”

– Contenido: texto, imágenes u otra información que se pueda publicar, cargar, vincular o poner a disposición de cualquier forma en la página web y en la plataforma web, independientemente de la forma del mismo.

– Dispositivo: cualquier medio electrónico que pueda acceder a la página web y plataforma web, como puede ser, a modo de ejemplo, un ordenador, un móvil o una “tablet”.

– Feedback y/o Reseña (indistintamente) comentarios, quejas o sugerencias enviadas por el usuario con respecto a la calidad, rendimiento o características del servicio ofrecido por Squeaky.

– Producto, Bien, Artículo o Anuncio (indistintamente): artículos o servicios ofrecidos para la venta, alquiler, subasta, contacto o cualquier otro medio de comercio ofrecido por Squeaky.

– Listado: que aparece en la plataforma web como visible para realizar una interacción comercial.

– Orden, Transacción, Operación o Compra-venta (indistintamente): interacción comercial entre usuarios con el objetivo de comprar, vender, alquilar o subastar por cualquier medio los artículos listados en la plataforma web.

– Términos y/o Términos y condiciones (indistintamente): Cualquier acuerdo aceptado por el usuario, pudiendo ser cualquiera de los siguientes o todos en su conjunto:

– Tercero o tercera parte (indistintamente): empresa o profesional conectado con la plataforma Squeaky y que interactúa con los Usuarios de la plataforma, incluidas las pasarelas de pago (como PayPal o Stripe,) proveedores de software, proveedores de red o proveedores de comentarios.

1.4. Modificaciones y/o actualizaciones.

En el supuesto hipotético de que se determinara la nulidad de cualquiera de los presentes términos y condiciones, ello no afectará al resto de los términos y condiciones, que permanecerán en pleno vigor.

Squeaky podrá modificar los presentes Términos y Condiciones, en cualquier momento, siendo aplicables las modificaciones conforme se detalla a continuación:

Los Términos y Condiciones aplicables serán los que consten en la aceptación de los mismos o subsidiariamente, para los casos en que no haya aceptación expresa por cualquier razón, los que consten en la página web (www.squeakycleantoys.com) en el momento de prestación de los servicios y/o de uso de la plataforma/web. No obstante, podrán ser de aplicación las modificaciones posteriores de tales términos y condiciones siempre que las mismas hayan sido comunicadas al usuario y haya transcurrido un plazo de 14 días naturales desde que se comuniquen al usuario sin que en dicho plazo haya oposición escrita. A efectos aclaratorios se entenderá que el usuario acepta los cambios si durante dicho plazo no planteara de forma clara, expresa, determinada, y en todo caso por correo electrónico, ninguna objeción a los mismos.

Estas modificaciones podrán tener fines, a efectos ejemplificativos pero ni limitativos, de:

– Adaptar las mismas a disposiciones legislativas o reglamentarias en vigor o en ‘vacatio legis’.
– Adaptarlos a cualquier decisión dictada por cualquier otra autoridad competente;
– Prevenir abusos o perjuicios o por razones de seguridad;
– Hacer que sean más claros o más justos;
– Reflejar los cambios en las condiciones del mercado o las prácticas del sector;
– Adaptarlos a los principios e imagen de la marca;
– Cualquier motivo que consideremos que mejora los precedentes.
– Modificar y/o mejorar la guía de buenas practicas de comunidad de la web.

La corrección de faltas de ortografía u otro tipo de errores que no modifiquen profundamente el significado y/o contenido de las disposiciones existentes no se considerarán cambios.

Cualquier modificación sustancial de estos Términos y condiciones, así como la fecha de entrada en vigor de dichos cambios, será comunicada a los usuarios por correo electrónico.

1.5. Aceptación de los términos y condiciones como condición ‘sine qua non’.

Para utilizar el Servicio prestado por Squeaky los usuarios deben aceptar los presentes Términos y condiciones sin restricción ni reserva alguna. Esta aceptación se concreta mediante un ‘click’ de validación durante su inscripción. Cuando el usuario cree una cuenta personal, en dicho momento, deberá aceptar los siguientes términos y condiciones, a los cuales se obligará desde entonces:

2. Información, identificación y documentación general.

Squeaky solicitará al usuario toda la información y documentación que a su juicio resulten necesarias para la adecuada y eficaz prestación de los Servicios y del correcto funcionamiento de la web. El usuario manifiesta y garantiza que está debidamente legitimado y facultado para la remisión de la documentación e información que facilite a Squeaky, y mantendrá indemne a Squeaky de cualquier reclamación de tercero por razón del acceso a la información o documentación remitidas por el usuario o a sus instancias. El usuario también tiene la obligación de informar sin demora a Squeaky de todo cambio que experimente la documentación y/o información inicialmente aportada (por ejemplo un cambio de domicilio o de correo electrónico); también existirá obligación por parte del usuario de informar a Squeaky por correo electrónico de cualquier cambio que realice en su cuenta que no sea considerada información o documentación (imágenes, detalles, texto, etc.).

El usuario autoriza a Squeaky a conservar una copia de los documentos e información que le sean facilitados para la prestación de los servicios y/o el correcto funcionamiento de la web incluso tras la terminación de la relación contractual. El usuario acepta que no puede eliminar la información que publique en la web, aun habiendo realizado y finalizado satisfactoriamente la transacción. Será Squeaky quien se encargue de retirar dicho contenido e información de la Web. En caso de que esto no se respete, Squeaky podrá tomar medidas al respecto contra el usuario, tales como penalizaciones económicas, pero en ningún caso tendrá responsabilidad en cuanto al contenido borrado y/o a las consecuencias de dicho borrado.

El almacenamiento de la información y de la documentación podrá realizarse en las instalaciones de Squeaky, en sus servidores o en instalaciones de terceros o medios de almacenamiento electrónico contratados por Squeaky.

Squeaky no asume ninguna obligación en relación con la verificación de la suficiencia y autenticidad de la información que se le proporcione por el usuario, siendo de exclusiva responsabilidad del usuario los daños y perjuicios que por dicha situación pudiera producirse, sin poder repetir dichos daños (ni el usuario ni terceros afectados) contra Squeaky en modo alguno.

Es decir, el usuario es directamente responsable de la exactitud, el contenido, la idoneidad y la legalidad del producto publicado. El usuario es responsable de verificar que sus transacciones sean legales en el país/estado del comprador (si se encuentra en el mismo país que el vendedor) y en el país del comprador (si se trata de una venta internacional), así como en el suyo propio. El vendedor tendrá la potestad en todo momento de aceptar o rechazar la solicitud del comprador.

Para utilizar el MarketPlace, tienes que utilizar el usuario y la contraseña creados durante la apertura de tu cuenta. El usuario se compromete a conservarlos en secreto. Salvo prueba de una utilización fraudulenta que no te fuese imputable, la responsabilidad de cualquier acción ilegal o fraudulenta será derivada a la persona titular de la cuenta. En caso de pérdida, de pirateo o de utilización fraudulenta del usuario y/o contraseña, el usurario tiene la obligación de advertir de inmediato sobre esta situación, así como de interponer las acciones legales oportunas.

3. Legislación aplicable general y sumisión expresa a los Tribunales Españoles.

La relación entre Squeaky y los usuarios se somete expresamente a la legislación española. Concretamente a la siguiente:

En materia de protección de datos:
– Ley Orgánica 3/2018, de 5 de diciembre, de Protección de Datos Personales y garantía de los derechos digitales.
– Reglamento (UE) 2016/679 del parlamento europeo y del consejo de 27 de abril de 2016.
– Guía sobre el consentimiento de la CEPD (2020)
– Guía sobre el uso de las cookies (2022) de la Agencia Española de Protección de datos.
En materia de Términos y condiciones generales de contratación, e-commerce y aviso legal:
– Real Decreto Legislativo 1/2007, de 16 de noviembre, por el que se aprueba el texto refundido de la Ley General para la Defensa de los Consumidores y Usuarios y otras leyes complementarias.
– Ley 4/2022, de 25 de febrero, de protección de los consumidores y usuarios frente a situaciones de vulnerabilidad social y económica.
– Ley 34/2002, de 11 de Julio, de Servicios de la Sociedad de la Información y Comercio Electrónico.
En materia de cumplimiento normativo y responsabilidad (‘Corporate compliance’):
– ISO 37301:2021 sobre establecimiento, desarrollo, implementación, evaluación, mantenimiento y mejora de los sistemas de gestión de compliance.c
– ISO 3100 sobre gestión del riesgo.
– Ley Orgánica 10/1995, de 23 de noviembre, del Código Penal sobre la responsabilidad penal de las personas jurídicas.
– ISO 3533 sobre requisitos de diseño y seguridad para productos en contacto directo con los genitales, el ano o ambos.
Los usuarios aceptan de forma expresa que, previamente a acudir a cualquier juzgado y/o tribunal, deberán resolver cualquier disputa directamente con Squeaky.

Las partes, con renuncia a cualquier otro fuero que pudiera corresponderles, acuerdan expresamente que serán competentes para la resolución de toda controversia derivada de estos términos y condiciones o que guarde relación con ellas -incluida cualquier cuestión relativa a su existencia, validez, terminación, interpretación o ejecución- a los Juzgados y Tribunales Españoles, y concretamente a los de la ciudad de Las Palmas de Gran Canaria.

El idioma en el que se deberán interpretar los términos, condiciones y/o políticas de Squeaky es y será el Español (de España) en todo caso, con independencia de los idiomas en los que puedan aparecer adicionalmente para mejor entendimiento de los mismos.

4. Uso del servicio de Market Place.

El usuario se compromete a utilizar la plataforma, sus contenidos y servicios, en todo caso y sin excepción ninguna, conforme con los siguientes principios:
– el ordenamiento jurídico Español, Europeo y cualquier otro aplicable en base a las circunstancias concretas del caso,
– los términos y condiciones recogidos en la página web y/o plataforma web
– las buenas costumbres
– el orden público
– la buena fe contractual
El usuario, al utilizar la plataforma web, declara:
– Que es una persona física y que es mayor de edad;
– Que tiene plena capacidad y todos los derechos para realizar las Transacciones en la plataforma web;
– Que entiende que es plenamente responsable, de acuerdo con estas Condiciones y la legislación aplicable, del cumplimiento de sus obligaciones en virtud de, exclusivamente, el acuerdo celebrado a título particular entre el Comprador y el Vendedor;
– Que Squeaky es un mero intermediario y que por ende le exonera de cualquier responsabilidad derivada de estas condiciones particulares pactadas a titulo individual;
– Que entiende que, al pedir un artículo, se compromete a comprarlo/pagarlo, y que el incumplimiento de esta Transacción podrá obligarle a reembolsar las pérdidas sufridas por el Vendedor, así como los gastos que esto le ocasione;
– Que entiende que, al vender un artículo, asume de forma exclusiva las responsabilidades que de esto se derive tales la garantía legal;
– que entiende que deberá pagar a Squeaky lo que le corresponde por la prestación de sus servicios, todo ello según lo dispuesto en el apartado 7 de los términos y condiciones generales de contratación (e-commerce).

En caso de que Squeaky, de forma unilateral, considere que el usuario ha violado alguno de estos principios anteriores, se reserva el derecho de limitar, suspender, restringir, bloquear, eliminar, expulsar y/o cancelar la cuenta del usuario de forma inmediata, así como eliminar todo el contenido que ésta haya publicado y cancelar cualquier operación de compra-venta activa y/o en marcha, todo ello de forma permanente y sin posibilidad ninguna de poder volver a crearse un nuevo usuario en la plataforma.

En todo caso, a efectos ejemplificativos y no limitativos, Squeaky cancelará (o análogos) la cuenta del usuario cuando entienda que el titular:

– Es menor de edad.
– No tiene capacidad legal para contratar o la tiene temporalmente limitada por cualquier causa.
– Incite a actuar (o simplemente actúe) de forma ilegal y/o irregular.
– Difunda o haga difamaciones, calumnias, injurias y/o contenidos o propaganda de carácter racista, xenófobo, LGTBIfobo, aporófobo, romanófobo, de apología del terrorismo, del fascismo, que sean inadecuados o que atenten contra cualquiera de los derechos humanos en cualquiera de sus formas.
– Publique falsedades (por ejemplo productos falsificados) o induzca al error (por ejemplo manipulado la descripción o el estado del producto).
– Suplante la identidad de otra persona o de otros usuarios.
– Utilice información falsa, documentación falsa y/o correos electrónicos ficticios para publicar anuncios.
– Cambie materialmente la descripción del artículo después de que el comprador haya realizado el pedido.
– Abuse del sistema de “denunciar” un anuncio para eliminar anuncios de otros usuarios.
– Haga publicaciones a modo de “Spam”o “multiposting”.
– Difunda mensajes que atenten contra la dignidad de terceros, la integridad moral y/o que sean de mal gusto o falten el respeto de cualquiera de las maneras.
– Use “spiders”, “scrapers”, “bots” o cualquier otro medio automático para acceder a la plataforma; para copiar, retirar, renovar, publicar contenido o actividades análogas.
– Infrinja los derechos de autor, propiedad intelectual, nombre comercial, marca registrada, patente, base de datos u otros derechos de propiedad intelectual que pertenecen o de los que tenga licencia Squeaky Clean Toys.
– Almacene de cualquier forma información y/o datos personales de terceros sin su consentimiento, incluidas las direcciones de correo electrónico, perfiles de redes sociales, direcciones de entrega, números de teléfono, etc.
– Haya tenido otro usuario y éste haya sido suspendido, cancelado, bloqueado y/o análogos.
– Publique productos cuya venta esté prohibida, productos artesanos o venda productos que se presuma que pueden ser robados, hurtados o sustraídos de cualquier forma.
– No cumpla con sus deberes y obligaciones tales como realizar el pago o facilitar el ejercicio de derechos de desistimiento o de garantía legal.
– Cause cualquier problema o inconveniente a la plataforma, a los demás usuarios, a terceros, anunciantes o cualquier otra parte
– No se respeten los términos y condiciones de la web y/o no hayan sido aceptados.
– No tener un método de pago válido conectado a la plataforma de Squeaky en todo momento.
En todo caso será Squeaky quien, de forma unilateral, interprete, aplique y decida, en atención a las circunstancias concretas de cada caso, qué medidas tomar contra el usuario, tanto dentro de la plataforma, de forma interna, como legal-judicialmente, de forma externa.

La apertura de una cuenta y la utilización de la web es gratuita (excepto los costes eventuales de la conexión a internet, en los que el precio depende de tu operador de datos, sin obligación de compra por la Web, así como las transacciones que se hagan dentro de la misma).

Los artículos que aparecen en la Web lo hacen con una descripción y con unas imágenes proporcionadas directamente por el propio usuario por lo que cualquier discrepancia en cuanto a la calidad, aspecto o diferencias con respecto a lo detallado, así como coincidencias con marcas registradas, será única y exclusivamente responsabilidad del usuario.

Si bien Squeaky puede ayudar a facilitar la resolución de disputas, no revisa, controla, aprueba y/o análogos, previamente a su publicación, la totalidad de los productos, usuarios y descripciones creados por imposibilidad material, humana y técnica. Tampoco hace propios los contenidos, productos, servicios, opiniones, comunicaciones, datos, archivos y cualquier clase de información de terceros recogidos en la plataforma. Todo ello sin perjuicio de que Squeaky aplica la máxima prudencia y diligencia debida en todo lo que hace, dentro de los límites técnicos, materiales humanos de los que dispone.

Asimismo, Squeaky no garantiza la licitud, fiabilidad, utilidad, veracidad, exactitud, exhaustividad y actualidad de los contenidos, informaciones, productos y servicios de terceros, la capacidad de los vendedores para vender artículos; la capacidad de los compradores para adquirir y pagar los artículos; o que cada parte cumpla con lo pactado en virtud de su condición. Squeaky tampoco garantiza de ninguna forma que los usuarios utilicen los contenidos y/o servicios conforme con la ley, las normativas aplicables, el orden publico, la buena fe contractual, ni los presentes Términos y condiciones. Todo ello sin perjuicio de que Squeaky aplica la máxima prudencia y diligencia debida de forma constante, dentro de los límites técnicos, materiales humanos de los que dispone, en todo momento.

El usuario autoriza a Squeaky a cargar los gastos automáticamente a su método de pago elegido de acuerdo con los términos y condiciones propios y los acuerdos de facturación aplicables que acepta al configurar o cambiar. Esto incluye, a efectos ejemplificativos pero no limitativos, los costes adeudados a Squeaky por la prestación de sus servicios. Squeaky notificará al usuario estos cargos cuando los realice. Los usuarios podrán cambiar su método de pago en cualquier momento, excepto cuando tengan transacciones activas y/o en transcurso.

Si los pagos o los montos adeudados a Squeaky no pueden completarse a través del método de pago registrado por cualquier motivo, el usuario seguirá debiendo a Squeaky todos los montos impagados, así mismo Squeaky se reserva el derecho de reclamar las deudas a través de los medios legales que estén a su disposición, sumando a la deuda principal los intereses y demás costes (como pueden ser los honorarios de Abogado/a y Procurador/a) en los que incurra para reclamar la deuda debida. El usuario declara y garantiza que tiene la capacidad legal de ser titular y usar cualquier tipo de tarjeta de crédito o débito u otro método de pago válido en relación con cualquier transacción realizada en la web al momento de realizarla y/o formalizarla.

5. Requisitos adicionales de publicación.

Al realizar una publicación en la web el usuario es el responsable directo y único de lo publicado; tanto del contenido, titularidad, idoneidad y legalidad de lo publicado, como de la exactitud y autenticidad de la descripción que haga del producto.

El usuario es el responsable de verificar que sus transacciones sean legales en sus respectivas regiones.

Todos los anuncios deben indicar el estado real en el que se encuentra el artículo.

Cualquier producto eléctrico, enchufable o con batería que transmita calor debe estar en perfectas condiciones y no presentar daños, como cables deshilachados o sueltos.

El usuario debe facilitar obligatoriamente un correo electrónico válido, activo y disponible al que tanto Squeaky como otros usuarios que sean parte de la transacción puedan dirigirse puntualmente para ejercitar el derecho de garantía legal. En caso de que los datos no sean correctos, sean falsos o ficticios, Squeaky se reserva el derecho a reclamar los daños y perjuicios que esto haya podido ocasionar.

6. Cerrar cuenta.

Si desea cancelar su Cuenta puede dejar de usar la web, eliminar su cuenta en el apartado correspondiente de la web, o comunicarse con Squeaky para obtener ayuda personalizada.

7. Productos.

Los productos que se publiquen en el Market place por los usuarios deberán ser idóneos, legales y cumplir con todas las garantías y certificaciones sanitarias exigidas y exigibles en la región en la que se encuentren y/o en la que se desarrolle la transacción, ya sea en la Unión Europea o en un país/estado ajeno. En todo caso, obligatoriamente, deberán cumplir como con lo estipulado en la ‘Guía de higiene’.

En todo caso, está fervientemente prohibido publicar y vender los siguientes productos:

– Artículos prohibidos o que no cumplan con la normativa vigente.
– Artículos que no cumplan con todas las garantías y certificaciones sanitarias.
– Artículos de procedencia incierta o sustraídos.
– Artículos que incumplan los derechos de propiedad intelectual y/o industrial del titular como los artículos de imitación.
– Artículos de muestra o promocionales.
– Productos con receta, medicamentos, suministros médicos profesionales, vitaminas, suplementos alimenticios o cualquier otro producto para la salud.
– Drogas;
– Armas de fuego u otro tipo de armas que tengan el objetivo de dañar la integridad física.
– Artículos que supongan un riesgo para la salud.

Los usuarios serán los responsables de cotejar que los productos que compren o vendan cumplen con todos los requisitos exigidos y exigibles en la región en la que se encuentren y/o en la que se desarrolle la transacción, ya sea en la Unión Europea o en un país/estado ajeno. Serán responsables de esto tanto compradores como vendedores. Squeaky no es responsable, por imposibilidad material y humana, de revisar que todos los productos listados en la web son idóneos, legales y cumplen con todas las garantías y certificaciones sanitarias de cada región, estado y país del mundo, por lo que serán los propios usuarios los que revisen el cumplimiento de estos requisitos sanitario-legales personalmente.

8. Responsabilidad.

El acceso a la web será voluntario, y, por tanto, responsabilidad exclusiva del usuario. El usuario será responsable de todo efecto directo o indirecto del uso que haga de la web, incluyendo, de forma informativa y no limitativa, todo resultado económico, técnico y/o jurídico adverso, así como de la frustración de las expectativas generadas por cualquier herramienta de la web, obligándose el usuario a mantener indemne a Squeaky por cualesquiera de las reclamaciones derivadas, directa o indirectamente de tales hechos.

Squeaky no se hace responsable de los perjuicios que se pudieran derivar de interferencias, omisiones, interrupciones, virus informáticos, averías y/o desconexiones en el funcionamiento operativo de este sistema electrónico o en los aparatos y equipos informáticos de los usuarios, motivadas por causas ajenas a Squeaky, que impidan o retrasen la prestación de los servicios o la navegación por la plataforma, ni de los retrasos o bloqueos en el uso causados por deficiencias o sobrecargas de Internet o en otros sistemas electrónicos, ni de la imposibilidad de dar el servicio o permitir el acceso por causas no imputables a Squeaky, debidas al usuario, a terceros, o a supuestos de fuerza mayor. Squeaky no controla, con carácter general, la utilización que los usuarios hacen de la plataforma.

En particular, Squeaky no responde en ningún caso de que los usuarios utilicen la plataforma de conformidad con la ley, los presentes Términos y condiciones, la moral y buenas costumbres generalmente aceptadas y el orden público, ni tampoco que lo hagan de forma diligente y prudente.

Squeaky no garantiza la disponibilidad, el acceso y/o la continuidad del funcionamiento de la plataforma. Asimismo, Squeaky no será responsable, con los límites establecidos por la Ley, de los daños y perjuicios causados al Usuario como consecuencia de la indisponibilidad, fallos de acceso y falta de continuidad de la web, de los servicios que ésta presta y/o de los productos que en ella aparecen.

En ningún caso Squeaky será responsable de los daños derivados o causados, en todo o en parte, como consecuencia de la falsedad, el ocultamiento, el retraso en el envío de información, el incumplimiento de las presentes condiciones generales, o cualquier otra conducta del usuario que fuera dolosa o negligente, o no realizada conforme a los principios de la buena fe, o de incumplimientos que se produzcan por causas que están fuera de su control razonable. En caso de que los datos, información, descripción, fotografías, estado, coste y análogos no sean correctos, sean falsos, tiendan al error o sean en todo o en parte ficticios, Squeaky se reserva el derecho de reclamar los daños y perjuicios que esto le haya podido ocasionar.

La web puede contener enlaces a sitios web o servicios de terceros que no son propiedad ni están controlados por Squeaky, no teniendo control por tanto sobre ellos, ni asumiendo por ende responsabilidad alguna derivada de esto; ni por el contenido, ni por políticas de privacidad, ni mucho menos por los términos y condiciones concretos de los sitios web o servicios de terceros.

Squeaky le recomienda encarecidamente que lea los términos y condiciones , así como las políticas de privacidad, de cualquier sitio web o servicio de terceros que visite o a los que algún link o anuncio alojado en la web le redirijan.

La responsabilidad de Squeaky se limitará, en su caso, a los daños directos (con exclusión, por tanto, del lucro cesante, de la pérdida de negocio o del daño reputacional-moral) efectivamente causados y fehacientemente probados al usuario. Dicha responsabilidad será como máximo de la cantidad de lo adquirido/vendido por el usuario. En caso de no haber adquirido/vendido nada, la responsabilidad será de un máximo de 100€.

TÉRMINOS Y CONDICIONES GENERALES DE CONTRATACIÓN – E-COMMERCE

1. Ámbito de aplicación.

Estos Términos y condiciones generales de contratación (E-commerce) son aplicables exclusivamente a la relación entre Squeaky y los usuarios, pero en ningún caso a la relación entre los propios usuarios. Las presentes condiciones regulan exclusivamente los honorarios derivados por el uso por parte de los usuarios de la web de Squeaky.

Squeaky es una plataforma web que permite a los usuarios comprar y vender juguetes aprobados para adultos, así como posibilitar la transacción económica de forma segura.

Por tanto, el Servicio principal de Squeaky consiste en ser una web que facilita la inserción (siendo previamente aprobados -o no- por Squeaky en base al cumplimiento de una serie de requisitos), por parte del vendedor, de anuncios de venta de juguetes para adultos, así como de su puesta en comunicación con posibles interesados; así como a posibilitar la propia transacción económica entre comprador y vendedor.

El uso de la web (página web y plataforma web-‘Market place’) implica la aceptación de todos los términos y condiciones, a saber:

Los presentes Términos y Condiciones generales de contratación complementan y refuerzan los Términos y condiciones de uso de la web. Ambos textos constituyen el marco básico de regulación de las relaciones establecidas entre “Squeaky” y el usuario y conjuntamente formarán el cuerpo que rige cada una de las relaciones establecidas entre “Squeaky” y el usuario, debiendo aplicarse e interpretarse éstas y aquellas (condiciones de uso y condiciones de contratación) conjunta y sistemáticamente.

Lo que no se exprese aquí, será de aplicación por analogía lo dicho en los Términos y condiciones de uso de la web.

2. Modificación y/o actualización de los términos y condiciones.

Squeaky podrá modificar los presentes Términos y Condiciones, en cualquier momento, siendo aplicables las modificaciones conforme se detalla a continuación:

Los Términos y Condiciones aplicables serán los que consten en la aceptación de los mismos o subsidiariamente, para los casos en que no haya aceptación expresa por cualquier razón, en la página web (www.squeakycleantoys.com) en el momento de prestación de los servicios y/o de uso de la plataforma/web. No obstante, podrán ser de aplicación las modificaciones posteriores de tales términos y condiciones siempre que las mismas hayan sido comunicadas al usuario y haya transcurrido un plazo de 14 días naturales desde que se comuniquen al usuario sin que en dicho plazo haya oposición escrita. A efectos aclaratorios se entenderá que el usuario acepta los cambios si durante dicho plazo no planteara de forma clara, expresa, determinada, y en todo caso por correo electrónico, ninguna objeción a los mismos.

Estas modificaciones podrán tener fines, a efectos ejemplificativos pero ni limitativos, de:

La corrección de faltas de ortografía u otro tipo de errores que no modifiquen profundamente el significado y/o contenido de las disposiciones existentes no se considerarán cambios.

Cualquier modificación sustancial de estos Términos y condiciones, así como la fecha de entrada en vigor de dichos cambios, será comunicada a los usuarios por correo electrónico.

3. Legislación aplicable.

– Real Decreto Legislativo 1/2007, de 16 de noviembre, por el que se aprueba el texto refundido de la Ley General para la Defensa de los Consumidores y Usuarios y otras leyes complementarias.
– Ley 4/2022, de 25 de febrero, de protección de los consumidores y usuarios frente a situaciones de vulnerabilidad social y económica.
– Ley 34/2002, de 11 de Julio, de Servicios de la Sociedad de la Información y Comercio Electrónico.

4. Obligaciones generales.

Para comprar o vender artículos en Squeaky primero deberá registrarse y crear una cuenta personal.

Tanto compradores como vendedores, previamente a poder realizar cualquier tipo de transacción a través del MarketPlace de Squeaky, deberán haber leído, entendido, aceptado y cumplido sin excepción:

5. Obligaciones particulares ineludibles.

a) Compradores.

• Haber leído, aceptado y cumplido sin excepción la guía de buenas prácticas del comprador (https://www.squeakycleantoys.com/us/guides-us/how-it-works-us/#buyers-guide/).

• Haber leído, aceptado y cumplido sin excepción la ‘Guía de higiene’.

• Marcar la transacción como completada en la plataforma web cuando el artículo adquirido se haya entregado en tiempo y forma.

De esta forma el vendedor podrá recibir el pago, desbloqueando el mismo la plataforma de pago y Squeaky podrá tener toda la información de la transacción de principio a fin. En caso de que el comprador no cumpla con esta obligación en el plazo máximo de 7 dias naturales, Squeaky se reserva el derecho a hacerlo por sí mismo. Squeaky igualmente se reserva el derecho de que las transacciones se completen automáticamente 30 días después de que el vendedor haya aceptado la transacción. En cualquier caso, las plataformas de pago también tendrán un tiempo establecido después del cual el pago se transfiere al vendedor, independientemente de si el comprador o Squeaky han completado la transacción; este plazo dependerá de cada plataforma.

b) Vendedores.

• Haber leído, aceptado y cumplido sin excepción la guía de buenas prácticas del vendedor (https://www.squeakycleantoys.com/us/guides-us/how-it-works-us/#buyers-guide/).

• Haber leído, aceptado y cumplido sin excepción la ‘Guía de higiene’.

• Contratar un servicio de mensajería con seguimiento del proceso en linea.

• Proporcionar al comprador el número de seguimiento del envío, través del sistema de mensajería de la plataforma web, para que así el comprador y Squeaky puedan seguir el progreso del envío en todo momento.

• Conservar en todo caso una copia del recibo del servicio de mensajería contratado para el caso de que surgiese cualquier problema o discrepancia.

• Mantener sus anuncios actualizados y estar disponibles para responder las preguntas o comentarios o solicitudes de compra en menos de 3 días. De lo contrario, Squeaky se reserva el derecho de pausar, cerrar, deshabilitar o eliminar todos todos los productos e incluso y su cuenta de usuario. Si el vendedor ya ha vendido el artículo, ha decidido quedarse con él y no venderlo, o si lo ha vendido en otro lugar ajeno a la plataforma web, debe eliminar el artículo en la plataforma web.

c) Comunes con respecto a Squeaky

Por cada transacción realizada, el usuario es conocedor y asume que debe realizar un pago a Squeaky por el uso de su web.

Aunque se ejerciten los derechos de garantía o se frustre la transacción por cualquier otro motivo, el usuario es conocedor y asume que los honorarios de Squeaky se mantendrán indemnes en todo caso, debiendo Squeaky cobrar sus honorarios en todo caso y no teniendo obligación de devolver cantidad ninguna pues el servicio, con independencia de que los usuarios cumplan finalmente con sus obligaciones contractuales, habrá sido correctamente prestado. Es decir, los honorarios y gastos deberán satisfacerse, en todo caso, aun cuando se frustre la transacción.

El usuario compensará en su totalidad a Squeaky (y a sus trabajadores y/o personas físicas-jurídicas que hayan participado en la prestación de los servicios) por cualquier pérdida o costes (incluidos los honorarios de profesionales, intereses, indemnización por daños y perjuicios y costes razonables) en los que incurra Squeaky, como resultado de cualquier incumplimiento por parte del usuario de los Términos y condiciones, del uso debido de la web de los Servicios prestados Squeaky o de cualquier ley o los derechos de un tercero, estén o no recogidos en los presentes Términos y condiciones. La obligación del usuario de pagar los honorarios y gastos a Squeaky es independiente de cualquier derecho que pueda corresponder al usuario frente a terceros por razón de los servicios prestados.

Es responsabilidad de las partes publicar reseñas honestas, reales y justas sobre como se desarrolló la transacción y sobre como fue la experiencia con el comprador/vendedor.

6. Transacciones.

6.1.- General.

Todos los precios reflejados son en dólares estadounidenses. Cada plataformas de pago hará las conversiones requeridas.

Cuando un usuario presiona el botón “comprar” e ingresa tanto los detalles de pago como la dirección de entrega, esto constituye una transacción per sé.

El pago del comprador por el precio del producto listado, los honorarios de Squeaky y los gastos de envío, en ese mismo momento pasarán a estar preautorizados -bloqueados en la entidad bancaria facilitada por el comprador.

Tras formalizar la transacción se informa al vendedor de esta solicitud de compra. Desde ese momento el vendedor tiene hasta 3 días para aceptar o rechazar la solicitud de compra. Si la acepta, la transacción continua y el sistema de pagos formaliza definitivamente el mismo; si la rechaza, la transacción se cancela y el servicio de pagos libera la cantidad “bloqueada”; Si no hay respuesta por parte del vendedor en esos 3 días, el servicio de pago cancelará la transacción y liberará la cantidad “bloqueada”.

Los vendedores, con independencia de los términos y condiciones de Squeaky, deberán cumplir y aceptar las condiciones de uso del sistema de pago que hayan elegido.

6.2.- Modificación de la transacción.

Los usuarios son responsables de cualquier modificación que hagan una vez se haya formalizado la transacción; no teniendo Squeaky responsabilidad ninguna por dichos cambios. A titulo ejemplificativo y no limitativo: precio del producto, gastos de envío, lugar de entrega, plazo de entrega, etc.

6.3.- Cancelación de la transacción tras su aceptación por el vendedor.

Si el Comprador cancela la transacción, tras haber sido aceptada por el vendedor, la cantidad pagada (incluidos los honorarios de Squeaky) no se reembolsarán en ningún caso.

Si el Vendedor cancela la transacción tras haberla aceptado, la cantidad pagada por el comprador se le reembolsará al Comprador y en ningún caso se le transferirá al Vendedor cantidad alguna.

Si la cancelación tuviese como justificación fuerza mayor o caso fortuito, o si el usuario cree que su pedido debe ser reembolsado por algún motivo extraordinario, puede comunicarse con Squeaky y trasladar el caso concreto, dando los mayores detalles posibles para su estudio.

7. Derechos y garantía.

Si bien el contrato de compraventa se hace de forma directa e independiente entre comprador y vendedor, y por tanto Squeaky en ningún momento es responsable del contenido, condiciones y demás términos particulares, a modo de orientación y a los efectos de recoger la normativa básica aplicable para que los usuarios tengan la información básica a su alcance en un ejercicio de transparencia y responsabilidad, el usuario debe saber que:

a) Derecho de desistimiento:

El derecho de desistimiento de un contrato es la facultad del consumidor y usuario de dejar sin efecto el contrato celebrado, notificándoselo así a la otra parte contratante en el plazo establecido para el ejercicio de ese derecho, sin necesidad de justificar su decisión y sin penalización de ninguna clase.

En la Unión Europea es de 14 días naturales como mínimo. Para el resto de territorios el usuario es el responsable de verificar qué derechos le amparan y qué plazos tiene para ejercitarlos.

Sin embargo, este derecho no es automático y tiene excepciones a su aplicación. La normativa aplicable recoge entre dichas excepciones a los contratos de “bienes precintados que no sean aptos para ser devueltos por razones de protección de la salud o de higiene”.

Por ende, los usuarios que compren a través de Squeaky no tienen derecho de desistimiento por regla general salvo en el caso de que el producto vendido a través de la web tuviese el precinto original, y el comprador no lo haya desprecintado en modo alguno. Todo esto deberá ser probado de forma fehaciente por quien pretenda ejercer el derecho al desistimiento.

b) Garantía

En caso de falta de conformidad entre lo comprado y lo recibido, por ejemplo por algún defecto o desperfecto del producto, el comprador podrá hacer uso de la garantía en los términos pactados libre e independientemente entre comprador y usuario a titulo particular, aunque en ningún caso podrá hacerse de forma más restrictiva a lo dispuesto legislativamente, a saber:

• Productos usados, de segunda mano, desembalados y/o desprecintados.

El vendedor responderá ante el comprador de cualquier falta de conformidad que exista en el momento de la entrega del bien, por ejemplo por algún defecto o desperfecto del producto, pudiendo el comprador, mediante una simple declaración por correo electrónico al vendedor, exigir la subsanación de dicha falta de conformidad, la reducción del precio o la resolución del contrato (con la devolución del producto y del dinero abonado respectivamente). En cualquiera de estos supuestos el comprador podrá exigir, además, la indemnización de daños y perjuicios, si procede y queda fehacientemente acreditado.

• Tiempo para ejercer la garantía.

El comprador podrá ejercer la garantía del producto frente al vendedor en un plazo de un año desde la entrega del producto.

Este plazo es para transacciones realizadas en la Unión Europea. Para el resto de territorios el usuario es el responsable de verificar qué derechos le amparan y qué plazos tiene para ejercitarlos.

• Gastos de devolución.

En caso de falta de conformidad y de que las partes pacten como opción la resolución del contrato, los gastos de devolución de envío correrán a cuenta del comprador en caso de ejercer el derecho de desistimiento y del vendedor en caso de ejercer la garantía.

c) Ejercicio de los derechos.

Cualquier disputa sobre una transacción debe ser resuelta, en primera instancia a titulo particular entre las partes (comprador y vendedor). En caso de que no pueda ser resuelta por la partes, o se haya intentado pero sin ningún resultado, entonces deberán notificar dicha disputa de la forma más detallada posible a Squeaky para que, dentro d leo posible, intente asesorar a las partes sobre el proceso a seguir.

Si se trata de una transacción realizada a través de Stripe, y las partes no están de acuerdo con una resolución, entonces la disputa se resolverá a discreción de Squeaky.

En todo caso es responsabilidad del comprador proporcionar pruebas fotográfica y/o de video del artículo, con el mayor detalle posible de las circunstancias, para justificar y probar de forma fehaciente cualquier disconformidad con el artículo adquirido.

En todo caso es responsabilidad del vendedor haber tomado pruebas fotográfica y/o de video del artículo, precinto, envoltorio, embalaje, y demás circunstancias, todo ello con el mayor detalle posible de las circunstancias, para poder probar de la forma más completa posible las condiciones en las que estaba todo en el momento del envío.

8. Honorarios de Squeaky.

Squeaky cobra el 23% de los precios finales pactados entre comprador y vendedor, aunque se reserva el derecho de cambiar dichos honorarios en cualquier momento din mayor obligación que comunicarlo a los usuarios. Será la empresa que gestiona las transacciones/pagos quien retenga tanto el precio del producto comprado-vendido como el porcentaje de Squeaky. En caso de que la empresa que gestiona los pagos no haga la retención y/o no pague el porcentaje correspondiente y mencionado a Squeaky, por cualquier causa, será el vendedor el responsable final del pago de los honorarios a Squeaky.

9. Responsabilidad.

El vendedor, cuando cierre un acuerdo con el comprador, será responsable de rechazar las ofertas no aceptadas en el plazo de 3 días.

El comprador será responsable de comunicar si, una vez recibido el producto, está conforme con la transacción para que ésta pueda cerrarse por parte de Squeaky y el pago se desbloquee en el plazo de 7 días.

En caso de que un usuario no cumpla con los Términos y condiciones, el usuario reconoce y acepta que será el único responsable de todas y cada una de las pérdidas directas e indirectas resultantes de terceros o de Squeaky, cuando la legislación lo permita.

En consecuencia, el usuario reconoce y acepta que, en la medida en que lo permita la legislación aplicable, y exceptuando los casos de incumplimiento de los Términos y condiciones, Squeaky no será en ningún caso responsable de los daños y perjuicios que pudieran sufrir usuarios y/o terceros en ningún caso y bajo ninguna circunstancia, menos aun cuando exista fuerza mayor o caso fortuito.

En particular, a titulo informativo pero no limitativo, Squeaky no será responsable de:

– acciones u omisiones de usuarios,
– la adecuación, exactitud, exhaustividad, la idoneidad y/o legalidad de cualquier contenido publicado por los usuarios;
– la seguridad, calidad y cantidad de los artículos que los usuarios vendan o compren a través de la plataforma web, ni de la (dis)conformidad de un artículo con la descripción proporcionada,
– cualquier problema con las Transacciones,
– Del derecho de desistimiento y/o garantía alguna

Squeaky no se responsabilizará del contenido generado por los usuarios. Los Usuarios serán los únicos responsables del contenido publicado. Los usuarios reconocen y aceptan que, en su calidad de proveedor de alojamiento, Squeaky no tendrá ninguna obligación contractual de realizar ninguna verificación del contenido y de los artículos anunciados y, en la medida en que lo permita la legislación aplicable, no se considerará responsable en ningún caso de los daños y perjuicios que sufran los usuarios y/o terceros en relación con dicho contenido y artículos. Todo ello sin perjuicio de que Squeaky aplica la máxima prudencia y diligencia en todo lo que hace, dentro de los límites técnicos, materiales y humanos de los que dispone.

De conformidad con sus obligaciones legales, Squeaky retirará de la web cualquier contenido ilícito o irregular que le haya sido debidamente comunicado, de forma suficientemente detallada y clara. En caso de que Squeaky detecte contenido o artículos que infrinjan, o puedan infringir, la legislación aplicable y/o las presentes Condiciones, Squeaky se reserva el derecho de tomar medidas internas contra el usuario, como puede ser eliminar su cuenta y bloquear las transacciones vigentes, así como legales/judiciales en caso de que así proceda.

Squeaky no se responsabilizará de las obligaciones fiscales, aduaneras o de información que puedan derivarse para los usuarios de sus actividades en la plataforma web. A los efectos de las Transacciones realizadas en el Sitio web, los propios Usuarios serán los únicos responsables de las obligaciones de declaración de impuestos, si se derivara alguna en virtud de la legislación aplicable.

En cumplimiento de las leyes y reglamentos aplicables, Squeaky toma todas las medidas apropiadas para proteger la seguridad de los datos proporcionados por los usuarios y para evitar que nuestros Servicios comprometan los datos y el software almacenados en los ordenadores, tabletas o smartphones de los Usuarios. Sin embargo, aun cuando Squeaky haya tomado las medidas apropiadas en consonancia con los requisitos legales, todo ello aplicando los principios de prudencia y diligencia, sus sistemas pueden verse comprometidos por acontecimientos imprevisibles como ciberataques o vulneraciones de seguridad en relación con la transmisión de datos o que afecten al volumen y la velocidad de las transmisiones de datos. En tales condiciones, sugerimos encarecidamente a los usuarios que tomen todas las medidas apropiadas para proteger sus propios datos y/o software, especialmente de la contaminación por cualquier virus que circule por Internet.

Squeaky no admite la entrega o recogida personal de los productos comprados en la web como una opción válida. Squeaky solo admite la entrega con seguimiento en línea, en la que el vendedor debe proporcionar al comprador el número de seguimiento del envío, registrado en un mensaje dentro del sistema de mensajería de la plataforma web, para que así el comprador y Squeaky puedan seguir el progreso del envío. Si por alguna razón comprador y vendedor acuerdan un envío que no sea en linea, entonces Squeaky no será responsable en modo alguno de cualquier discrepancia surgida.

Los vendedores deberán conservar en todo caso una copia del recibo del servicio de mensajería contratado para el caso de que surgiese cualquier problema o discrepancia. Si por alguna razón el vendedor no conserva dicha copia del recibido, Squeaky no será responsable en modo alguno de cualquier discrepancia surgida.

La responsabilidad de Squeaky frente al usuario en relación con los servicios está condicionada a que el usuario remita reclamación por escrito, determinando con suficiente detalle la naturaleza de la reclamación y el importe reclamado, en un plazo preclusivo no superior a un año a contar desde la finalización de la prestación de los Servicios, salvo en caso de dolo en que será de aplicación el plazo de prescripción legalmente establecido.

La eventual responsabilidad de Squeaky tendrá, en su caso, lugar únicamente frente al usuario. Squeaky no será responsable de los daños que puedan ocasionarse a terceros como consecuencia del uso que el usuario pueda hacer de los Servicios fuera de la finalidad dada y recogida en los presentes Términos y condiciones, a menos que dicho uso haya sido expresamente autorizado por Squeaky, en cuyo caso la responsabilidad de Squeaky se ajustará a las condiciones acordadas a tal efecto.

Los usuarios deben cumplir con los términos del proveedor de pago que elijan utilizar. Squeaky en ningún caso será responsable de los problemas que puedan derivarse de dicha transacción económica. Las tarjetas bancarias (tarjetas de crédito o tarjetas de débito) suelen estar sujetas a controles de validación y autorización por parte de la entidad bancaria que emite las mismas. Si Squeaky no recibe la notificación de autorización requerida a tiempo no será responsable de ningún retraso o falta de entrega.

Los usuarios reconocen y acepta que los artículos se compran y venden “en el estado en el que se encuentran” y “según disponibilidad”.

REQUISITOS COMUNITARIOS

INTRODUCCIÓN
Este es simplemente un mercado para comprar y vender de forma segura. Todos los usuarios del mercado deben ser activos y apoyar a otros Usuarios y a Squeaky.

Si el moderador siente que un usuario no está siguiendo las pautas de la comunidad, se le puede dar una advertencia, se puede cerrar su lista o se puede desactivar su cuenta sin previo aviso.

Deshabilitar una cuenta puede ser solo una medida temporal, mientras que el equipo de soporte puede chatear con un usuario y volver a encarrilar las cosas. Tendemos a tener una regla de 3 veces: si un usuario no cumple con los requisitos, la cuenta se desactivará en la tercera vez .

Envíenos un correo electrónico si ve algo que no sigue estas reglas o pautas.

PROPIEDAD DEL CONSUMIDOR
Este es un mercado privado de consumidor a consumidor. Solo crea listados para artículos que posees personalmente. Este tampoco es un lugar para vendedores comerciales o anfitriones de fiestas en casa que venden los artículos nuevos.

SEGURIDAD CORPORAL

¡El material de juguete es un tema importante! Los vendedores deben consultar nuestro último política de seguridad para el cuerpo y mantener su listado actualizado para cumplir.

Los compradores no deben ofrecer ni solicitar que se use el artículo comprado antes del envío. No pida que le envíen artículos usados adicionales. No le pida al vendedor que incluya artículos adicionales que no cumplan con nuestra política de seguridad corporal o los requisitos de publicación.

El vendedor está obligado a limpiar todos los artículos de acuerdo con la guía de higiene. El comprador debe hacer lo mismo cuando reciba el artículo.

MANTENLO LIMPIO
Asegúrese de que sus comentarios no puedan interpretarse como perversos, intrusivos o irrelevantes para vender o comprar el artículo. No le preguntes a un vendedor cómo usa el artículo o sus preferencias y tampoco compartas las tuyas.

Las imágenes pornográficas o el chat sexual no están permitidos, ni en ningún lugar ni en ningún momento.

Si el moderador siente que cualquier detalle, como descripciones o nombres para mostrar, puede ser ofensivo , será editado.

FALSO
Si hay algo, en opinión del moderador, que parezca ser spam, falso o inapropiado de alguna manera, Squeaky tomará las medidas necesarias para garantizar la integridad del sitio, los datos y los usuarios.

SABE COMO FUNCIONA
No tomar ninguna acción o tomar acciones incorrectas, o simplemente no comunicarse, puede causar grandes problemas para usted o para los demás.

Es responsabilidad de cada miembro comprender cómo funciona el mercado y, en particular, cómo funciona una transacción. antes de que entren en uno!

PAÍS
La página de perfil de su cuenta debe mostrar en qué país se encuentra.

AUTÉNTICO Y PRECISO
Todo el mundo depende de la palabra escrita y las imágenes en una lista de ventas, así que asegúrese de que siempre sea clara, detallada, completa y precisa.

EDICIONES SQUEAKY
Es posible que Squeaky tenga que hacer una edición ( por ejemplo , el título de la lista o el nombre para mostrar) para que sea más explicativo o único. No realice cambios en ninguna edición SQUEAKY. Comuníquese con nosotros si hay algo que no le hace feliz.

TIENDA ABIERTA O CERRADA
Una vez que se envía un artículo para su listado, deberá revisar los comentarios de su listado. Desplácese hacia abajo en su listado regularmente para ver los comentarios del equipo de SQUEAKY o de compradores potenciales. Users are responsible for any modifications they make once the transaction has been formalized; Squeaky is not responsible for such changes. By way of example and not limitation: product price , shipping costs, place of delivery, delivery time, etc.

6.3.- Cancellation of the transaction after its acceptance by the seller.

If the Buyer cancels the transaction , after it has been accepted by the seller, the amount paid (including Squeaky’s fees ) will not be refunded in any case.

If the Seller cancels the transaction after having accepted it, the amount paid by the buyer will be refunded to the Buyer and in no event will any amount be transferred to the Seller.

If the cancellation was justified by force majeure or a fortuitous event , or if the user believes that their order should be reimbursed for some extraordinary reason , they can contact Squeaky and transfer the specific case, giving as much detail as possible for their study.

7. Rights and guarantee.

Although the sales contract is made directly and independently between the buyer and the seller, and therefore Squeaky is at no time responsible for the content, conditions and other particular terms, as a guideline and for the purpose of collecting the basic regulations applicable to that users have the basic information at their fingertips in an exercise of transparency and responsibility, the user must know that:

a) Right of withdrawal: The right of withdrawal from a contract is the right of the consumer and user

to cancel the contract entered into, thus notifying the other contracting party within the period established for the exercise of that right, without the need for justify their decision and without penalty of any kind.

In the European Union it is a minimum of 14 calendar days . For the rest of the territories, the user is responsible for verifying what rights they have and what terms they have to exercise them.

However, this right is not automatic and has exceptions to its application. The applicable regulations include among these exceptions the contracts for “sealed goods that are not suitable to be returned for reasons of health protection or hygiene”.

Therefore, users who buy through Squeaky do not have the right of withdrawal for general rule except in the case that the product sold through the web had the original seal, and the buyer has not unsealed it in any way.All this must be reliably proven by whoever intends to exercise the right of withdrawal.

b) Warranty

In the event of a lack of conformity between what was purchased and what was received, for example due to a defect or damage to the product, the buyer may make use of the warranty under the terms agreed freely and independently between the buyer and the user in a private capacity, although in no way In this case, it may be done in a more restrictive way as provided by law, namely:

• Used, second-hand, unpacked and/or unsealed products.

The seller will respond to the buyer for any lack of conformity that exists at the time of delivery of the good, for example due to a defect or damage to the product, the buyer being able, by means of a simple declaration by email to the seller, to demand the correction of said lack of conformity, the reduction of the price or the resolution of the contract (with the return of the product and the money paid respectively). In any of these cases, the buyer may also demand compensation for damages, if applicable and if it is reliably accredited.

• Time to exercise the guarantee.

The buyer may exercise the product warranty against the seller within a period of one year from the delivery of the product.

This term is for transactions carried out in the European Union. For the rest of the territories, the user is responsible for verifying what rights they have and what terms they have to exercise them.

• Devolution costs.

In case of lack of conformity and that the parties agree to terminate the contract as an option , the return shipping costs will be borne by the buyer in case of exercising the right of withdrawal and the seller in case of exercising the guarantee.

c) Exercise of rights.

Any dispute about a transaction must be resolved, in the first instance in a private capacity between the parties (buyer and seller). In the event that it cannot be resolved by the parties, or has been attempted but to no avail, then they must notify Squeaky of the dispute in as much detail as possible so that, as far as possible, it tries to advise the parties on the process. to follow

If this is a transaction made through Stripe, and the parties do not agree to a resolution, then the dispute will be resolved at Squeaky ‘s discretion .

In any case, it is the buyer’s responsibility to provide photographic and/or video evidence of the item , with as much detail as possible of the circumstances , to justify and reliably prove any non-conformity with the item purchased.

In any case, it is the seller’s responsibility to have taken photographic and/or video evidence of the item , seal, wrapping, packaging, and other circumstances, all with the greatest possible detail of the circumstances , in order to prove in the most complete way possible the condition in which everything was at the time of shipment.

8. Squeaky Fees.

Squeaky charges 23% of the final prices agreed between buyer and seller, although it reserves the right to change said fees at any time without greater obligation than notifying users. It will be the company that manages the transactions/payments who retains both the price of the product bought-sold and the percentage of Squeaky . In the event that the company that manages the payments does not make the withholding and/or does not pay the corresponding and mentioned percentage to Squeaky , for any reason, the seller will be ultimately responsible for the payment of the fees to Squeaky .

9. Responsibility.

The seller, when closing an agreement with the buyer, will be responsible for rejecting the unaccepted offers within 3 days.

The buyer will be responsible for communicating if, once the product is received, they are satisfied with the transaction so that it can be closed by Squeaky and the payment is released within 7 days.

In the event that a user fails to comply with the Terms and Conditions, the user acknowledges and agrees that they will be solely responsible for any and all direct and indirect losses resulting from third parties or from Squeaky, where permitted by law. .

Consequently, the user acknowledges and accepts that, to the extent permitted by applicable law, and except for cases of breach of the Terms and Conditions , Squeaky will not be in any way responsible for any damages that users may suffer. and/or third parties in no case and under no circumstances, even less when there is force majeure or fortuitous event.

In particular, by way of information but not limitation , Squeaky will not be responsible for:

– actions or omissions of users,
– the adequacy, accuracy, completeness, suitability and/or legality of any content published by users ;
– the safety, quality and quantity of the articles that users sell or buy through the web platform, nor the (dis)conformity of an article with the description provided,
– any problems with Transactions,
– The right of withdrawal and/or any guarantee

Squeaky is not responsible for user- generated content. Users will be solely responsible for the published content. Users acknowledge and agree that, as a hosting provider, Squeaky shall have no contractual obligation to perform any verification of the content and items advertised and, to the extent permitted by applicable law, shall not be held liable in no case of damages suffered by users and / or third parties in relation to said content and articles. All this without prejudice to the fact that Squeaky applies the utmost prudence and diligence in everything it does, within the technical, material and human limits available to it.

In accordance with its legal obligations, Squeaky will remove from the web any illegal or irregular content that has been duly communicated to it, in a sufficiently detailed and clear manner. In the event that Squeaky detects content or articles that violate, or may violate, the applicable legislation and/or these Conditions, Squeaky reserves the right to take internal measures against the user, such as deleting their account and blocking current transactions. , as well as legal / judicial in case it proceeds.

Squeaky will not be held responsible for tax , customs or information obligations that may arise for users from their activities on the web platform. For the purposes of the Transactions carried out on the Website, the Users themselves will be the only ones responsible for the tax declaration obligations, if any are derived by virtue of the applicable legislation.

In compliance with applicable laws and regulations, Squeaky takes all appropriate measures to protect the security of data provided by users and to prevent our Services from compromising data and software stored on Users’ computers, tablets or smartphones. However, even when Squeaky has taken appropriate measures in line with legal requirements, all while applying the principles of prudence and diligence, your systems may be compromised by unforeseeable events such as cyber-attacks or security breaches in connection with the transmission of data or that affect the volume and speed of data transmissions. Under such conditions, we strongly suggest users take all appropriate measures to protect their own data and/or software, especially from contamination by any viruses circulating on the Internet.

Squeaky does not accept the delivery or personal collection of products purchased on the web as a valid option . Squeaky only supports delivery with online tracking , in which the seller must provide the buyer with the tracking number of the shipment , registered in a message within the messaging system of the web platform , so that so the buyer and Squeaky can track the progress of the shipment . If for any reason buyer and seller agree to ship offline, then Squeaky will not be responsible in any way for any discrepancy that arises.

Sellers must keep in any case a copy of the receipt of the contracted courier service in case any problem or discrepancy arises . If for any reason the seller does not keep said copy of the receipt, Squeaky will not be responsible in any way for any discrepancy that arises.

Squeaky’s responsibility towards the user in relation to the services is conditioned on the user submitting a claim in writing, determining in sufficient detail the nature of the claim and the amount claimed, within a preclusive period not exceeding one year from the completion of the provision of Services, except in the case of fraud in which the legally established limitation period will apply.

The eventual responsibility of Squeaky will have , where appropriate, place solely against the user . Squeaky will not be responsible for any damages that may be caused to third parties as a result of the use that the user may make of the Services outside the purpose given and included in these Terms and Conditions, unless such use has been expressly authorized by Squeaky, in which case Squeaky’s liability will be adjusted to the conditions agreed for this purpose.

Users must comply with the terms of the payment provider they choose to use. Squeaky will in no case be responsible for any problems that may arise from said economic transaction. Bank cards (credit cards or debit cards ) are usually subject to validation and authorization controls by the bank that issues them . If Squeaky does not receive the required authorization notification on time it will not be responsible for any delay or non-delivery .

Users acknowledge and agree that items are bought and sold “ as is” and “as available ” .

COMMUNITY REQUIREMENTS

INTRODUCTION
This is simply a marketplace to buy and sell securely. All users of the marketplace need to be active and supportive of other Users and of Squeaky.

If the moderator feels that a user is not following the community guidelines, they may be given a warning, their listing may be closed, or their account could be disabled without warning.

Disabling an account may only be a temporary measure whilst the support team can chat with a user and get things back on track. We tend to have a 3 times rule – if a User fails to meet the requirements, the account will be disabled on the 3rd occurrence.

Please email us if you see anything that doesn’t follow these rules or guidelines.

CONSUMER OWNED
This is a private consumer to consumer marketplace. Only create listings for items you own personally. This is also not a place for commercial vendors or home party hosts selling new items.

BODY-SAFETY
Toy material is an important subject! Sellers should check our latest body-safe policy and keep your listing updated in order to comply.

Buyers should not offer or request your purchased item to be used before shipping. Do not ask for extra used items to be sent. Do not ask the seller to include extra items that do not comply with our body-safe policy or listing requirements.

The seller is required to clean all items according to the hygiene guide. The buyer is required to do the same when they receive the item.

KEEP IT CLEAN
Make sure your comments could not be interpreted as pervy or intrusive or irrelevant to selling or buying the item. Don’t ask a seller about how they use the item or about their preferences and don’t share yours either.

Pornographic images, or sexual chat is not allowed – not anywhere, and not at any point.

If the moderator feels that any detail such as descriptions or display names might be offensive they will be edited.

FAKE
If there is anything, in the moderator’s opinion, that appears to be spam or fake or inappropriate in any manner, Squeaky will take whatever actions are necessary to ensure the integrity of the site, the data, and the users.

KNOW HOW IT WORKS
Taking no action or taking incorrect actions, or simply not communicating can cause huge problems for yourself or others.

It is each member’s responsibility to understand how the marketplace works and particularly how a transaction works -. before they enter into one!

Your account profile page should show which country you are based in.

AUTHENTIC & ACCURATE
Everyone depends on the written word and the pictures in a sales listing so make sure it is always clear, detailed, and complete, and accurate.

SQUEAKY EDITS
Squeaky may have to make an edit (e.g. listing title or display name) in order to make it more explanatory or unique. Don’t make changes to any SQUEAKY edits. Reach out to us about it if there is something you aren’t happy about.

SHOP OPEN OR CLOSED
Once an item is submitted for listing, you will need to be checking your listing comments. Scroll down your listing regularly to see any comments from the SQUEAKY team or from potential buyers. Check your emails for system notifications, or, check your account daily to see them in your inbox.

If you know you will not be able to be available ( e.g. away on holiday or off ill), pause your listings by closing them and then re-opening when you’re active again. Or, ask SQUEAKY to do it for you – it’s all part of the service!

RESPONSES
Try to respond as soon as possible, and within 3 days maximum.

We expect our sellers to answer all comments, even if you feel it is unnecessary because other users are watching to see if you are active or not. If you are active, even with a very short response, then it encourages more action from others, so it’s a win-win.

If a seller misses a sale through no action, or doesn’t answer any direct email or listing comment from the Squeaky team, or comment on a listing by Squeaky then it is assumed a buyer would also not get a response, then we have to close the listing.

If you are a buyer requesting a pricing change, please don’t just disappear after the seller has taken the trouble to change their listing for you.

If the moderator feels that a buyer is continually stringing sellers along, not responding, or never getting to the point of buying, then their account may also be disabled.

MESSAGING
Keep all communication kind, positive, and respectful.

This isn’t a chatty site – messages should be simple and clear, and only about transacting with the listing (item detail, international shipping quotes, or bids for the item).

All pre-sales messages must be publicly seen as comments at the bottom of all listings.

Try not to waste sellers time by asking questions already answered in the listing or listing comments.

For the safety and security of our community, personal information must not be offered, shared, requested, or disclosed to any other users on your profile, your listing, in messages, images, or even within the transaction messaging (apart from delivery details). This includes emails, phone numbers & social media info. After payment is pre-authorized, the buyer can enter delivery address and any packaging requirements privately -only the seller and Squeaky can see it.

If personal information is offered, requested, or even shared, do not respond – Squeaky will deal with it.

STAYING WITHIN THE MARKETPLACE
In order to protect both buyers and sellers, we need to see all communications between buyer and seller so if there is any indication that we may not see it all, then we can’t know what could have been discussed between buyer and seller, so we can’t offer any unbiassed help or be able protect you.

We do understand that within the transaction there may be other information you want to add but cannot, so if that’s the case then you need to email hello@squeakycleantoys.com, and let’s see what we can do to help.

Do not advertise any other businesses, and do not encourage any other connection outside the marketplace.

Speak to the Squeaky team about any issues or errors and try to get them solved within the marketplace. Wait until Squeaky has advised that there is nothing else that can be done within the marketplace to resolve your problem, before you go elsewhere to solve it (otherwise you could be unknowingly causing problems for other users or for Squeaky.)

Everything you need to operate securely through the marketplace is already in place. If there is any indication that trading outside that marketplace is offered by the seller, or requested by the buyer, the moderator can disable the account with immediate effect.

Do not try to arrange payment outside of the marketplace – by staying in the secure payment system you have any protections they offer, and we will have a record of the buyer/seller message exchange, in case of any disputes.

PURCHASING
The payment systems will pre-authorize your funds for each and every time you request to purchase so buyers should only make one purchase for the same item and wait then for the seller to accept or reject it.

Buyers should check any extra import fees they may have to pay outside the marketplace,, before hitting the BUY button.

Sellers should only accept one request to purchase the same item (accept one and reject any others – even if it is from the same buyer).

Sellers must not ask buyers to complete the transaction or write a review before the item has been received and the buyer has examined the item.

INTERNATIONAL SHIPPING
Buyers must request an international shipping quote, by way of a message to the seller on the listing, and then, if agreed with the seller, wait for the listing to be edited with the new shipping price before hitting the buy button.

DELIVERY ADDRESS
PayPal buyers should not change the address auto-filled by the PayPal payment system. For protection purposes, the item must be delivered to the address registered with the buyer’s PayPal account so you should change the address on PayPal first, before starting a transaction.

HYGIENE GUIDE

INTRODUCTION
It is often recommended, in online advice, to even sanitize new toys you buy from a store, and as part of a general maintenance and good hygiene practice it is also important to clean/sanitize your own sex toys before and after you use them.
Selling toys on to another user is different to a using/sharing a sex toy with another person in the heat of the moment. It appears that the much longer time delay between the use of the toy by the seller to the use of the toy by the buyer seems to offer a significant advantage as this will allow most germs to die off naturally. Cleaning and sanitizing is required to kill off more. So, by the time a sterilized toy has been left unused, cleaned, then packaged up, and mailed, and delivered to you, the chances of catching anything are vastly reduced. However, our users still have to go further and follow this guide in order to minimize any risks of infection from one user to another.

If you are not comfortable doing this on your used, insertable/penetrable items, please do not list the item on the marketplace.

SUMMARY OF USER GUIDELINES AND REQUIREMENTS

All toys listed on the marketplace have to adhere to the Squeaky body-safe policy which means the materials of the toys that need the most sterilization are effectively non-porous, so they should be able to withstand at least one of the required fuller level of sterilization methods outlined in this guide.
However, with all cleaning, sanitizing, HLD (high level disinfection) and sterilizing, it is recommended that you choose the most suitable method described in this guide, depending on the toy’s purpose, it’s usage, and the material and design of your toy. In order to understand what is most suitable, please also read the manufacturer´s instructions for your specific toy, and please also take note of the additional cautionary notes on design and material in this guide.

BEFORE YOU SELL, AND, AFTER YOU BUY
a) For toys (Unopened, or, Opened but used) that are not in a package with the hygiene seals still intact, they may have been touched, the seller is advised to sanitize the toy, but the buyer is required to at least sanitize the toy before use (Process P1 or P2 below).
b) For all used insertable / penetrable parts of listing items (i.e. can be inserted into or is penetrable by any orifice e.g. ball gags, dildos etc.), or toys that are used on intimate areas (e.g. the cap on a clitoral suction toy): even if only tried once, these toys need to be cleaned most intensely – to the point of the highest level possible at home – this means using at least one of the P3 processes) disinfection/sterilization methods in this guide. For all toys that require the more intense P3) disinfection/sterilization processes, the seller is required to do this before listing, rather than just before shipping, and the buyer is required to carry out the same level of hygiene (at least one of the P3 processes) on these items after they receive the goods, and before they use them.
c) Sellers are required to tick the appropriate listing boxes to make the buyers aware of the current condition of the toy, and if disinfecting or sterilization is required
d) It is a listing requirement for all sellers, to upload a picture or video with their listing, of the hygiene process in progress. Taking a good one shows your buyers the level of care you have taken and the methods and tools you have actually used.
e) If the toy has any grooves, ridges, buttons etc. pay special attention to these areas when cleaning as germs can gather here so take extra care to clean these areas really thoroughly. Good advice is to buy a toothbrush or nailbrush to dedicate only to the cleaning of your toys. Take nozzles off and deal with them separately.

f) The P1) basic cleaning routine and P4)rinse and P5) drying process, should be done before all other sanitizing, HLD/sterilization, and should also be done again after using any chemicals on your toy.
g) Rinsing and drying are equally important. Also see processes P4) rinse well and P5) dry well and make sure no cleaning solution gets lefts in the grooves.
h) Give lots of air drying time (24hrs) before putting anything back together, then store it in a suitable box or lint-free bag (use the original one if you have it) to keep it clean and away from dust and germs.

i) Sellers are strongly advised to take dated/timed pictures or video showing clearly the close-up condition of the item before the ship it.
j) If the buyer receives an item and feels that the hygienic condition is not the same as shown on the listing, the buyer is required to take dated/timed pictures or video showing clearly the close-up condition of the item before they contact the seller about it or dispute the transaction.

NOTE TO BUYERS
Despite your new purchase appearing to be perfectly clean once it arrives, you also need to thoroughly clean and sanitize, disinfect, and sterilize it yourself, where appropriate.
To clean and sanitize it, wash it twice in soapy water, then use the manufacturer’s recommended toy cleaning spray or an alcohol solution (described in the process section of this guide) if appropriate for the material. Rinse well, then dry it slowly and thoroughly, and store it in a clean box or bag. To disinfect or sterilize it further, follow the guidance given in the Process section below. Don’t just follow exactly what the seller did – make your own informed choices from the information in this guide.

NOTE TO SELLERS
Sellers should only be selling toys that meet our body-safe criteria. It´s important that all sellers make every effort to pass on their unwanted adult toys in a spotless condition – just the same condition that you would like to receive them yourself.
Please give your unwanted adult toys an especially thorough clean first. Then sanitize it as explained below, and then, if it has been used, even only once – follow the appropriate P3) HLD/Sterilization method in this guide. If your toy can take it, why not do it twice by carrying out two methods. We would advise doing both bleach and boiling for example – as two separate processes ( never together as it is toxic and dangerous to mix bleach with hot water) . We would strongly recommend using both these methods, where possible, or bleach and hot air oven method for any anal toys.
Don’t forget to provide at least one good photo of the process P3 in progress.
The buyer’s don’t want to just trust it is done. They want to see it!

Definitions: Cleaning, Sanitizing, Disinfecting, Sterilizing.

First, let’s put them in the order of intensity. Cleaning is also the first essential step to do before you do any of the others and is also often the last step when you have used chemicals to clean on your toys.

1. CLEANING means removing visible dirt, dust and other soils from surfaces. It usually involves soap and water and wiping a surface clean.

Or, more appropriate to sex toys, it is the process that physically removes all visible body fluids or any other foreign material such as dust.

The simplest method of cleaning your toys after each use is to use a mild non scented soap plus warm water, careful cleaning, and the occasional sanitization or sterile disinfection will make your toys safer for you and easier to sell on.

Sanitizing them with appropriate wipes or toy cleaners can be a form of cleaning, or mild disinfection. So a low for of sanitization is essentially the same as cleaning, a high form of sanitization can be regarded as a low form of disinfecting.

SQUEAKY use of the word CLEANING:
Cleaned – soap & water
Cleaned – Toy cleaner product
Laundered is the term used for clothes and accessories that can normally be laundered.

SANITIZING is simply a term that could mean cleaning or disinfecting or both.
It removes bacteria from surfaces, so it takes germs to a low level.
It can also be a diluted form of disinfecting- using anti-bacterial soap and water, a sanitizing (disinfectant) wipe, or in the top layer of the dishwasher for example.
Depending on the product you use, and the length of time the cleaner is in contact with the toy, then the level of sanitization will vary all the way from sanitizing to disinfecting.
By the way, Vodka and other liquors are not strong enough alcohols to disinfect – as they are only around 40% alcohol.
The strongest type of sanitization is usually a disinfection that will kill a certain level of germs from surfaces. It can be done with a 70% (or higher) isopropyl rubbing alcohol as a wipe or a disinfectant spray. It will take you far, but not all the way to sterilization because it cannot kill all the viruses. So this kind of sanitization is still not the fuller sterilization that Squeaky requires for any used insertable/penetrable toys.
SQUEAKY use of the word:
Sanitized – minimum 70% alcohol or disinfectant wipe

DISINFECTING means using chemical disinfectants (chemicals) to kill harmful bacteria, and viruses from surfaces.

It doesn´t necessarily remove visible germs, you still need to clean the toy to wipe them from the surface first.

It is important to distinguish between sterilization and disinfection. Whereas sterilization results in destruction of all forms of microbial life, disinfection results in destruction of specific pathogenic microorganisms. (Found on a Penn State College of Engineering manual)
Disinfectants are usually divided into 3 levels – low, intermediate and high level. ( according to Biosafety in Microbiological and Biomedical Laboratories (BMBL) 5th Edition ). Medium to low level can effectively just be sanitization, and high level disinfections. Not all high level disinfectants kill all the same germs, which is why we choose chlorine bleach as the best chemical form of disinfecting here.

The EPA also provides a list here, of all EPA-registered tuberculocides and disinfectants that are effective against HIV and HBV so you could check with the suppliers about using these on a sex toy. But they also say when referring to the use of bleach as a high level disinfectant “An EPA-registered sodium hypochlorite product is preferred, but if such products are not available, generic versions of sodium hypochlorite solutions (e.g., household chlorine bleach) can be used.” (Ref:“https://www.cdc.gov/infectioncontrol/guidelines/disinfection/index.html

This article from the National Library of medicine also describes the use of alcohol vs. bleach as a disinfectant. (Note though that they give a recipe of 1:100 for simply disinfecting surfaces, as opposed to the higher level of 1:10 required for a more intense sterilization of sex toys.) We would like to explore the use of natural alternatives to bleach if you are going to do this more often, but we haven’t found enough evidence based facts to take this further for now. In any case, when selling a sex toy, this is the time to use a strong product like bleach at least just this once!

SQUEAKY’s use of the word:
Disinfecting is not a catchall term when it comes to the results achieved by different type of products – they don’t all achieve the same results on the same germs. The many, wide and varied ‘disinfectant’ products on the market also just seems to lead to too much confusion with the users about how or when to use them, if at all. So we also don’t want to have users having to mess around unnecessarily with chemicals without having evidence-based facts to support every possible disinfectant product on the market. This is why Squeaky is choosing only the highest level evidence-based disinfectant (chlorine bleach) with dilutions and timings to achieve the maximum effect on germs etc.

STERILIZING is a term that is now often used synonymously with disinfecting. It can include all sorts of methods and it means killing all microorganisms from surfaces, not just bacteria and viruses.

So it means killing everything, but we’re only interested in killing of everything harmful to humans.
The term pasteurization is where heat is used to kill off anything that is harmful to humans. We are all more familiar with this term when it comes to milk or cooking food but not usually for sterilizing inanimate objects! Recently we have seen it mentioned on the internet when referring to the boiling of sex toys, but the only evidence we have seen of the heating point of pasteurization is actually lower than boiling point. Pasteurization defined by a “heating to below boiling point (generally 77?C) for up to 30 minutes” in an article on Sterilization and Disinfection in the Laboratory -(Found on a Penn State College of Engineering manual). This article ( ref: https://solarcooking.fandom.com/wiki/Water_pasteurization) shows that pasteurization of water at a temperature of 60 °C (140 °F) will get rid of Shigella bacteria. The Holder method of pasteurization is the most widely used and is defined by the Frontiers microbiology site as 62.5°C for 30mins (https://www.frontiersin.org/articles/10.3389/fmicb.2018.00926/full). An interesting study about how to eliminate the HPV in a mother’s breastmilk ,on researchgate concluded “Conclusions: The results presented here indicate that the Holder pasteurization is an efficient procedure to inactivate high-risk and low-risk HPV thus preventing the potential risk of their transmission through human donor milk.” ref: https://www.researchgate.net/publication/258147224_Inactivation_of_high-risk_human_papillomaviruses_by_Holder_pasteurization_Implications_for_donor_human_milk_banking
The most common way of sterilizing in hospitals appears to be with large auto-clave machines used to steam sterilize instruments. You can now even buy small autoclaves (they look like pressure cookers) on Amazon, but we don’t imagine our users will have one of these as they are still very expensive.

“Moist heat or heat under steam pressure is the agent used in autoclaves. Putting steam under 15 psi (Pound per square inch) achieves a temperature of 1210 C. At this temperature, all microorganisms and their endospores are destroyed in approximately 15 minutes of exposure for media preparation and for hospital waste disposal autoclaving should be done for 45-60 minutes. Moist heat is the sterilization method of choice for heat-stable objects.”

Less often used in a medical facility is dry heat sterilizers. Dry heat sterilizers kill microorganisms through prolonged exposure to materials (1.5-3.0 hours) at higher temperatures than moist heat sterilizers. it’s useful for items that aren’t waterproof, but they still have to be heatproof and the slow rate of heat penetration and microbial killing makes this a time-consuming method.
High temperatures are not suitable for most materials so we offer a process for the high level disinfectant of chlorine bleach here too.

Large UV-C machines can be used in medical environments to sterilize more fragile tools such as those used for Ultrasound procedures. Ref: https://www.fda.gov/medical-devices/coronavirus-covid-19-and-medical-devices/uv-lights-and-lamps-ultraviolet-c-radiation-disinfection-and-coronavirus We´ve all seen retail versions of UV-C sterilizers advertised for mobile phones, toothbrushes, or baby bottles, and there are now UV-C machines, usually, box or sealed bag, specifically for sex toys too. The light (usually around 260 nm wavelength) emitted by UV lamps is also germicidal, and can be used to reduce the number of pathogenic microorganisms on exposed surfaces and in air.

SQUEAKY’s use of the word:
Sterilization is, in effect, the highest level of disinfection. Disinfection has been a term widely used for killing germs by using chemicals. The use of a chlorine bleach solution can be referred to as a HLD (high level disinfection). Sterilization has also traditionally been the term used in medical environments for non-chemical sterilization of tools, using heat (wet steam, or dry). We now see UV-C machines referred to as sanitizers, disinfectants and sterilizers – sometimes all on the one product!

We have also seen the boiling water method referred to as pasteurization and also as field disinfection (WHO: Field Guide to Sterilization and High level disinfection of medical instruments https://apps.who.int/iris/bitstream/handle/10665/41538/WHO_AIDS_2.pdf;jsessionid=EB924457BAA1A95F6491C65A27337CA0?sequence=1)
All of this could be explained by the fact that all these terms are referring to processes rather than products, for example a weak bleach solution may only sanitize whereas a strong one may be a high level disinfectant. The process involves factors such as tools, timings, intensity levels of the ‘germ eliminating’ product (for want of a better word!)
If it’s confusing for us then we have to assume that the information overload on this is also confusing for the buyers, so we will keep things simple here and offer a choice of the highest levels of disinfecting and sterilizing methods
possible at home, and define the intensity and the timing where appropriate.
In order to group these together and give emphasise that the maximum possible process must be used here, we may call it ‘sterilizing’.

Chlorine bleach 1:10 solution + rinse
Boiling water (20 minutes rolling boil)
Hot air oven (320° F /2 hrs, 340° F / 1hr)
UV-C lamp (260-280nm)

OTHER METHODS
We have seen articles showing toys ‘disinfected’ on the top rack of your dishwasher – on the hottest setting, with no detergent, but equally, there are articles debating whether this is enough for a full sterilization. Dishwashers generally reach 120℉ (49℃)or maximum 140℉ (60℃), but can reach up to 180℉ (82℃)

We do not think the water gets hot enough, so, until we know more, and since we are asking our sellers to do this for someone else, we do not recommend this dishwasher method.

Other methods we are currently investigating are steaming with a pressure cooker, or microwaving. Pressure steaming (using a pressure cooker!) referred to as a sterilization technique in this midwives’ field sterilization article ( https://en.hesperian.org/hhg/A_Book_for_Midwives:Clean_and_sterilize_tools) and other unusual alternative methods are referenced in this CDC article (ref: https://www.cdc.gov/infectioncontrol/guidelines/disinfection/sterilization/other-methods.html). However, we need some further verification before adding any other home methods to the Squeaky hygiene guide processes.

THE PROCESS
CLEAN & SANITIZE – STERILIZE – RINSE & DRY & STORE
This is the process for non-porous toys only.
It is recommended that you carry out the most suitable type of further sterilization outlined below, depending on the toy’s purpose, it’s usage, and the material and design of your toy.
With all cleaning, please follow the manufacturer´s instructions and also the safety instructions on any tools or products you are using. Make sure you don’t do anything they have advised against. Please also read to the end of the page and check the additional notes for different toy design and material, and when you should or should not use the different methods.

Follow the advice, and heed the warnings. If you aren’t sure of anything, ask us first at hello@squeakycleantoys.com

Your toy may have a coating for aesthetic or allergenic purposes, so be extra careful to ensure your cleaning does not remove this.
Make sure you get into all the nooks and crannies, and clean all relevant parts and removable parts to the correct level.

If your item gets damaged in the process, it should not be listed.
If it stops working, or has any cracks or spilts, sharp edges or rough patches the toy should be disposed of, and definitely not listed on the marketplace.

PROCESS P1) CLEAN
Washing, or wiping
Wash or wipe using a mild, non-irritating soap and warm water to remove all dirt and dust. It is also a requirement to rinse well (process P4) after using chemicals, and dry well (process P5) and store well (process P6) after cleaning.

Toy cleaner is also a good way to clean your toys. It may even give you a higher level of cleaning, or put another way it will give a weak form of sanitization. Since we can’t know what is in every toy cleaner, we tend to regard toy cleaners as more of a soap cleaning alternative.

Do this cleaning before you do any deeper cleaning or disinfecting you always need to clean it first. Don’t forget to rinse any soap or chemicals off after.
After you bleach sterilize a toy it is also good give the toy a wash with a neutral soap again to counter any bleach odor. Then rinse well!

PROCESS P2) SANITIZE
Special soaps, wipes, sprays
Sanitizing is a higher level of cleaning and should be done with antibacterial soap, alcohol or bleach wipes/sprays/solutions. It is also a requirement to rinse well (process P4) after using chemicals, and dry well (process P5) and store well (process P6) after all methods.
Sanitization is sufficient for many bacteria and is good for toys that have not been used, for accessories like nipple clamps or handcuffs for example, or the main sex machine part that is not the insertable part.
With all anti-bacterial products, be careful to check how long the product has to be in contact with the toy in order to have an effect, and then make sure you rinse it off thoroughly when the job is done.
NOTES:
Always make sure you rinse the soap or chemicals off after.
If you are ever using alcohol to sanitize first, make sure you do not go from using alcohol on your item to then immediately using bleach.
Never mix alcohol products with bleach. Bleach and alcohol are a toxic mix – always make sure you wash, rinse and dry your toy thoroughly after using alcohol.
Alcohols are volatile and flammable and must not be used near open flames, and only use in well-ventilated spaces only..
Prolonged and repeated use of alcohol as a disinfectant can also cause discoloration, swelling, hardening and cracking of rubber and certain plastic and dissolve certain types of glue.

PROCESS P3) HIGH LEVEL DISINFECT & STERILIZE
Boiling, baking, bleach, or UV-C. These are not effective without prior cleaning of the sex toy, so it is a requirement to clean the toy first. It is also a requirement to rinse well (process P4) after using chemicals, and dry well (process P5) and store well (process P6) after all methods.

a) Boiling (20mins rolling boil)
Boiling is best if your item can be wholly boiled. Your non-porous toy material and design must also be able to stand it and of course it needs to be waterproof.

The water needs to be bubbling for a constant 20 mins in a pan.
When it’s finished, use clean tongs to remove the items from the boiling water.

NOTES:
• Do not boil toys parts with a battery inside, a motor, electronic or electrical parts. Batteries should not be exposed to extreme heat.
• Do not boil toys that have delicate add-ons e.g. gems, or if they are made up of layers of different materials.
• Do not boil ‘silicone’ toys if they are not 100% silicone or ‘glass’ toys if they are not 100% borosilicate.
• Do not boil ABS plastic toys.
• Do not touch metal toys after boiling – give them time to cool before handling, but use gloves of course so as not to introduce any more germs.
• It’s best to put the toy in the water whilst it is heating up so as not to shock the toy material by putting it straight into boiling water – then start the clock only when the water starts to boil.
• Do not run your toys under a cold tap straight after boiling as the contrast in temperature may warp the toy.
• We have seen it recommended to use a buffer like a clean cloth along with glass or stainless steel toys so that they don’t jump around the pan and get knocks and scrapes on them.

b) Bleach solution & Rinse (1:10 for 10-15mins)
Use 5.25%-6.15% sodium hypochlorite, the regular/domestic/household bleach, often referred to as ‘chlorine bleach’ is the one we are referring to when we say ‘bleach’. The dilution for cleaning clothes and even for disinfecting household surfaces is less but for sex toys it has to be 1:10 (10% bleach solution).

Even though it´s a weak solution of bleach you use (10% bleach, 90% cool water), you will be leaving it in the solution for 10-15 minutes so it´s really important to also make sure you rinse it well after, and also give it a final thorough clean with a non-scented soap and water solution afterwards to remove any possible bleach residue.

Blot them dry with a clean paper towel perhaps, but make sure they are well air dried afterwards. You shouldn´t leave them moist and ready to collect any germs, so air drying and exposure to sunlight to dry them is usually much better for them.

NOTES:
If you can use bleach on your toy and it is fully waterproof, then you should be able to immerse it fully in the 10% bleach / 90% cool water solution.
If your toy is not fully waterproof, then you still need to find a way to get the bleach solution to reach and stay in contact with the essential insertable parts for at least 10 minutes. There are alternative ways to make the bleach solution stay in contact with the insertable part. See some examples on the website or marketplace listings of vibrators with all the essential parts standing in a measuring jug or glass.
If the toy is only splashproof, put the bleach solution in a spray bottle and spray the item carefully making sure you get the solution into all the parts , nooks and ridges and around buttons etc.
In all cases, make sure you leave the solution in contact with the toy for 10-15 minutes. Ten minutes minimum is essential for the bleach to work here.
Equally important with the bleaching is the subsequent thorough rinsing to ensure that no bleach remains on the toy before it is used again.
This should be followed by a long (24hrs) natural air drying period afterwards to get rid of any bleach smells.

WARNINGS:
• Any dilution of these, or re-use of the same bleach solution will mean you´re sanitising, not disinfecting.
• Make sure it is plain regular strength (6 percent) chlorine bleach, and do not use splash-less or concentrated bleach, or bleach that has fragrance, or household cleaners that ‘contain bleach’.
• Don’t use out of date products –otherwise it will have degraded.
• Make sure your item is not porous material at all, check with the manufacturer if your item can withstand bleach. It may be too sensitive, may change colour or the make-up of the material may change. (Bleach can ruin porous toys and also it would stay in the little pores and make it too unsafe to re-use again – we do not accept porous toys on the marketplace.)
• Ensure that you wear appropriate personal protective equipment ( PPE) to system, skin, or mucous membranes of the eyes, nose, or mouth. PPE can include gloves, gowns, masks, and eye protection. (e.g., gloves, apron, eye protection or face shield, face mask for respiratory protection)
• Use the bleach product safety precautions.
• Chlorine, especially as bleach, is highly alkaline and can be corrosive to metal and can also damage some plastics
• Never mix alcohol products or hot water with bleach. Bleach and alcohol are a toxic mix – always make sure you wash, rinse and dry your toy thoroughly after using alcohol. Also, if you are ever using alcohol to sanitize first, make sure you do not go from using alcohol on your item to then immediately using bleach.
• NEVER use hot or boiling water with any level of bleach solution- it releases a poisonous gas.
• Never use an old mixed solution, never re-use a bleach solution as they won’t be as effective.
• Bleach can corrode metals and damage painted surfaces.

c) UV-C lamp (260-280nm – follow lamp instructions for distance and timing)

The seemingly easiest,but more expensive method, for any type of non-porous toy with a simple shape could be to use a UV-C ray surface sterilizer. There are even some products specifically marketed for sex toys ( e.g. B-Vibe and UVEE Clean). The only issue with these is that only the areas that the UV light has reached are actually sterilized so you need to make sure this is possible. The light must reach reach the actual surface of all the parts of it that could house germs, and cannot sterilize the inside of containers for example. The effective rays do not shibe through the object to sterilize the inside!

UV -C sterilization is also a process, and not just a tool. So it is important to know that the machine used can produce enough intensity at the correct wavelength (usually 260-280nm), for the correct length of time, at the correct distance from the item surface, and for the correct volume of space the item takes up. Follow the UV-C machine instructions carefully.

If a seller is using a UV-C machine, they must state which machine is used so that buyers can check reviews online for that machine in order to check the sterilizer specification and reported authenticity & quality (look out for fakes). If you are buying a machine, make sure to buy some proper UV-C dosimeter cards to check its effectiveness.

NOTES:

It is also essential that the correct safety protocols are adhered to for the machine you are using ( e.g. UV-C goggles and gloves, and make sure the UV-C does not shine on your skin). UV-C boxes are often the better solution for safety if they automatically switch off when opened.

d) Hot air oven baking (320° F (160° C) for 2 hours, or 340° F (170° C) for 1hour)
The most common time-temperature relationships for sterilization with hot air sterilizers are 170°C (340°F) for 60 minutes, 160°C (320°F) for 120 minutes, and 150°C (300°F) for 150 minutes.

“An ordinary convection oven, or even a toaster oven, may be used for this process.

The item or items to be cleaned must be placed on a clean surface, not directly on the oven rack. This helps prevent any organisms already in the oven from being transferred to the item. When sterilizing many items at one time, they should generally be placed in the oven spaced about 6 inches (about 12 cm) apart. This allows the warm air to flow freely around the items, which is necessary for proper sterilization.

The oven should be preheated to 320° Fahrenheit (160° C) for sterilization in two hours, or 340° F (170° C) for sterilization in one hour. Preheating should be done for about 20 minutes before the object is placed inside the oven, to help ensure that the oven is hot enough to do its job.

The item should then be placed on the center rack of the oven and left to heat.

After the item is heated, it should be allowed to cool inside the oven for an hour or two. This prevents the item from being contaminated as it cools.
The user should then remove the item from the oven with a clean, heat-safe glove.

NOTES:
It’s important to use a fan oven for this method in order to get a more even sterilization.
“A forced air oven or hot air oven is simply an oven with a fan. Most domestic and laboratory ovens these days have a fan to help distribute the heat evenly around the oven. Without a fan you will often get cold or hot spots, meaning uneven heating, drying or testing.” It’s also known as a convection oven.

This method may only suit the highest quality materials like stainless steel, borosilicate glass or the highest quality silicone materials – check with your manufacturer.

Notes taken from the allthescience.org guide: The heat can go deeply into thick objects, achieving an in-depth sterilization effect. Even items inside packaging can be sterilized this way. Metallic objects that can handle heat well can be sterilized quickly at high temperatures. Dry heat is non-corrosive for metallic materials as it contains too little moisture.The process involves no toxic agents. There are no harmful substances that will remain in the environment.

Warning:
Make sure there aren’t any other materials, glues or delicate parts on your toy that would not suit this method.

PROCESS P4) RINSING
Rinsing thoroughly is just as important as cleaning.
You need to make sure you are not leaving any chemicals ( e.g. soap, toy cleaner, alcohol, bleach ) still on a toy that will be touching any part of the body!

PROCESS P5) DRY
Again, drying fully is important for both cleanliness and fresh smelling.
Blot dry, air dry, leave it in a well-ventilated place for 24hrs, or in sunlight if that is ok for the material. You want to make it as fresh as possible.

PROCESS P6) STORE
Remember that your buyer will be in a different environment when they open the package so make sure your item is nice and fresh, clean and sterile before storing away – otherwise you could trap any stale or perfumed smells with it. Take the item outside to check it in natural light and fresh air for a final check before you pack it away.
Then store it away neatly and safely, for example in a clean silk or satin bag or box that is lint free and dust free, so that the condition of the toy doesn’t change. The best way to store it is usually in the box and /or storage bag it came with when you bought it.
Silicone toys in particular may absorb smells in the room it is stored in ( smoke, perfume etc.) so make sure you store the item in a clean, cool, dark, dry place in an area where there are no other environmental smells to absorb.

ADDITIONAL NOTES ON DESIGN & MATERIAL

NON-POROUS WATERPROOF TOYS
Design: no batteries or motors
Materials: pure silicone, borosilicate glass, stainless steel
Examples: Dildos & plugs by Bad Dragon, Mr Hankey, SquarePeg toys

• Waterproof toys usually have an IPX7 rating.
• UV-C machine, or boiling is good but check the manufacturer’s instructions to make sure it won’t deform your toy.
• Toughened glass is generally fine to boil, but not soda glass.
• We’ve seen it advised to put a cloth in the pan also if you are boiling a glass dildo for example – to protect it when the boiling makes it jiggle – makes sense!
• If you are unsure about boiling, use the chloring bleach method
• For waterproof toys, if you are able to use the bleach method, don’t put the battery area / power point area into the solution if it isn’t tightly sealed! This part is not usually inserted into the body in any case.

ABS PLASTIC & TOYS WITH COATINGS
• Check the manufacturer’s instructions ( especially with plastic toys or PU toys) to see if you can even use alcohol at all on the toy material or coating material.
• If your toy is has a PU coating, it could react to a disinfectant wipe – so check first.)
• ABS /Plastic toys should not be boiled at all, and bleach can damage some plastics so check the manufacturer’s instructions.

NON-POROUS TOYS WITH MOTORS
Design: mains powered or battery-powered
Materials: silicone or ABS plastic
Examples: vibrators, body wands, masturbator holders, thrusters, vibrators.

• If they are waterproof, it will say they can be put in the bath and usually have an IPX7 waterproof rating so you should be able to immerse them in the bleach solution if you are sure that the seal is completely tight around the battery compartment.
Check the manufacturer’s instructions (especially with plastic toys) to see if the insertable part is waterproof enough for you to soak them in a 10% bleach solution (that is, 1 part bleach to 9 parts water) for 10 minutes minimum – then do that and rinse that part really really well. Then clean again with soap and water and give it a thorough rinsing and a good long ( 24hrs) air drying – this is so important to make sure there is no bleach chemical residue or smell.
• If you are not sure if they are waterproof, you should NOT submerge them in water or a water /bleach solution.
• You can often still bleach sterilize just the insertable part. We seen a seller show a picture of this type of toy being cleverly sterilized in the bleach solution, by leaving it in a tall narrow container like a glass or measuring jug – where the motorized handle part is sitting outside the liquid!
• ABS /Plastic toys should not be boiled at all, even if the motor/ battery part out of the water because the even hotter steam will get into object too, and if you’re holding the item the steam will burn your hand!
• We saw an interesting point made in allure.com article on how to clean your toys without damaging them. “With some motorized silicone toys, such as a strap-on dildo that comes with an insertable bullet vibrator, you can just take out that part and let the hot water do its work.“
• Probably the easiest method but most expensive method for these toys is to use an authentic UV-C machine.

NON-POROUS SPLASHPROOF TOYS
• Splashproof toys cannot usually be submerged in water for a length of time.
• You can’t boil splashproof toys.
• Dry heat sterilization could be a good option for metal or borosilicate glass, and some silicone toys can – you should check with the manufacturer of your silicone toy to see if it can withstand the higher temperatures.
• Check with your manufacturer about bleaching your plastic toys – we don’t believe bleach and plastic are a good mix. So the best solution here is to use an authentic UV-C machine.
• If you can’t immerse your toy, check if you can use a spray bottle and spray the bleach solution completely over the toy. • The more expensive borosilicate glass and stainless steel, Aluminium or Titanium are the optimum. Soda glass is an altogether different kind of glass and is much more fragile. 100% silicone is by far the best mainstream toy material to have to buy and sell. So, know your toy and what the manufacturer said you can do with it.
• Not all non-porous materials can be sterilized fully by bleaching or boiling. Resin is just one example, and it isn’t known if UV-C would alter the structure either.
• For leather accessories, you should generally wipe them down with soap & water after each use. Make sure they dry properly. Use a leather cleaner periodically to keep them in good condition. Also, check the manufacturer’s instructions first before you disinfect them by using a 70% (or higher) isopropyl rubbing alcohol because a Webmd article on uses of rubbing alcohol says it’s not good for wood or leather

OTHER IMPORTANT FACTORS

CLEAN-SMELLING TOYS
As well as rinsing any chemical odors after sterilizing, be sure that any other possible odors have been removed e.g. cigarette smoke, or body odours on clothes or toys. If you´re bleaching it anyway with a 10% solution this will probably do the trick anyway, or baking soda and lemon.
We have also seen baking at 350℉ for 30mins to remove odors, is recommended by Tantus for their high quality silicone toys.
In general, airing and exposing a cleaned toy to sunlight really helps here. You might have to leave it in sunlight for a few days but it´s worth it surely.
If you are sterilizing by boiling – do it for a lot longer – up to 30 mins to get rid of odors. If the toy is 100% silicone, you could also add just a little vinegar to the water when boiling it. Adding a little vinegar to the water when washing clothes always helps take away odors !
As long as the material allows, you could also try the usual household solution of baking soda and water solution that gets rid of odors.
Thinking of more natural solutions, coconut oil as a lube on silicone really helps. Rub the coconut oil into and leave it for a few hours, then clean it with unscented soap and water as usual. Not a bad thing to do after every use of a butt toy I´d say.

PROTECT YOURSELF
Take appropriate care and wear protective gear when using bleach, boiling water, or UV-C lights.
Read the instructions on any tools you are using.
Rinsing is more important than you might think…. and so is air drying.
